Video released last weekend shows Ryan Conklin of Monroe County, New York, being detained by three police officers for simply asking a question.
Conklin recounted his trip to a Henrietta Hots restaurant with a friend to blogger Davy V., recalling how he noticed three Monroe County Sheriffs deputies inside the restaurant and decided to ask them a question.
I simply asked three Monroe County Sheriffs, why they all were all at Henrietta Hots when it is a busy holiday weekend, and I suggested they be split up and police the area, taking staggered breaks, Conklin said.
During the full discussion, my hands were behind my back in a non-aggressive manner.
Apparently taking offense to his question, Sheriffs deputy Philip Bartela yelled I suggest you turn around at Conklin before again yelling Are you a badass? Ryan was then promptly arrested.
The three sheriffs got in a triangle around me and I was then thrown against the wall and handcuffed, Ryan said.
Despite continuously asking why he was being detained, Ryan was given no answer and was instead treated like a violent criminal. Ryan also recounted his bizarre treatment during his two hours locked in a cell. I was placed in a holding cell for two hours for simply asking our public servants a question, Ryan said. Locked in a cell with handcuffs on while a Sgt. was present and while all the deputies frantically looked up New York State Penal Law. Monroe County officials say that deputies did the right thing by detaining Conklin. Were actually pleased the video is out there, Sgt. John Helfer told WHEC. The video is very supportive of the deputies actions, the actions he took when dealing with the individual. The individual was told a number of times to turn around, put his arms behind his back and he did not comply with a lawful order. What you see in part two of the video that you dont see in part one was, before that, there were a number of opportunities for him to go on his way. He was offered that opportunity and he continued his belligerence. He actually approached the deputy and got in his face more or less at the restaurant and it continued from there. Ryan, who has no criminal record, was eventually charged with disorderly conduct.
A few weeks ago, a 14 year old school girl, left a handwritten note castigating a police officer for bad parking on his windshield. The Officer was polite, humble and slightly amused at having been issued this citizen’s warrant. In this, a grown man, near the age of the officers approaches them with a sarcastic tone. It should not be the case, but many police officers are subject to peer pressure like other people. This pack behavior is more likely when they outnumber the ‘foe’ three to one. He should have kept his mouth shut, and they should have just let it go.
So you're more concerned about a guy behaving in an obnoxious but legal manner, than you are with government agents abusing their authority?

I was cuffed by cops because some females said I did something wrong (but I honestly did not, not even close.)
The only thing I did “wrong” was not tell the police exactly what happened. I told them I lived in the area and was just walking outside the supermarket.
They tried to get more information, but since I knew from experience....
So they continued to up the pressure, but I told them I had already given them all the info.
Then the bad-@$$ among them told me to put my hands behind my back. I was already seated. I wanted to get up to help them put the cuffs on. The bad-@$$ growled, “SIT DOWN.”
I did, but continued to refuse to offer more info. They eventually let me go, but not after humiliating me in front of my neighbors with the cuffing and all.
I lodged a complaint against the officers, but I got a letter from the department that said, “EXONERATED” in all caps like that! There’s a bunch more stuff they did, all intended to get me to react in a way that could give them an excuse to bring me to the police department.
Don’t believe a word they say. Don’t offer more than is absolutely necessary. Don’t assume they are on your side.
There are good guys among them, but assume they are going to use the info against you and twist what you say, and say and do many things to make you react, resist arrest, you name it.
I was better off getting cuffed than offering information!
actually, this could be considered “Contempt of Cop” which brings it into a First amendment issue.
BTW...SCOTUS has already recognized that verbal criticism of a police officer is protected speech

There are some laws on the books, I think California that makes it an arrestable offense for disturbing a police officer for non emergency reasons.

used to eat breakfast at the Stagecoach in Elk Grove CA. Many deputies and CHP officers. Once I asked the deputies sitting next to us if they would give us a head start when we drove away. They said don’t worry, we’re not traffic cops, they’re over there (pointing at the CHP).
