NBA Suspends Clippers’ Owner Donald Sterling For Life, Imposes $2.5 Million Fine

LOS ANGELES (CBSLA.com) — NBA Commissioner Adam Silver announced Tuesday Clippers owner Donald Sterling will be suspended for life and fined $2.5 million in response to the racist remarks he allegedly made in a recorded audio clip.

Silver spoke to the press at 11 a.m. news conference from New York, stating he will “do everything in my power” to force the sale of the Clippers.

“The hateful opinions voiced by that man are those of Mr. Sterling. The views expressed by Mr. Sterling are deeply offensive and harmful. That they came from an NBA owner only heightens the damage and my personal outrage,” Silver said. “I am banning Mr. Sterling for life from any association with the Clippers association or the NBA. Mr. Sterling may not attend any NBA games or practices, he may not be present at any Clippers facility, and he may not participate in any business or decisions involving the team.”

But now somebody has both standing, and PROOF of harm by the collective action of the NBA monopoly.

For something that was both legal and occurred in private.

I THINK the NBA acted out of pressure from the Players Union before the lawyers had a good chance to review the risk.

This will be a very big friggin' deal in the history of the NBA. Very big.

Unlike Baseball, NBA does not have an exemption from anti-trust law.

He’s been talking like that for years.
Don’t care myself that the old guy got caught but
he should have known sooner or later someone would take advantage.

I don’t see how the NBA can impose a fine on someone they are banning. Seems to me the only reason he would pay the fine would be if he wanted to stay. Does the NBA really have the power to levy a fine on someone severed from the organization? This is WAY overboard IMO.

More than that, California's wiretap law may mean that EVERYBODY who relayed or used an illegally-obtained recording of a private conversation may be civilly liable. I'm sure he has lawyers looking into that.

And to seal the deal, the NBA made it clear today that the action was solely due to the recording, and had nothing to do with any previous rumors or transgressions…..so you may just be right.

Would love your thoughts on this, fellow sports guy. I'm seeing a private conversation, illegally recorded, and extreme punishment without apparent due process. Surely there are conduct clauses inserted in every franchise agreement but this just defies the imagination. I don't condone what he said, of course, but I wonder where the NBA will stand when the inevitable lawsuit is filed.

While I agree with you in principle, I think that the Bill of Rights only limits governmental entities, not private individuals or corporate interests. That's why your employer can snoop on your activities on the net and etc. So this might be allowable in theory. I would disagree with the punishment level. I don't think it can be legal to restrict a man's possessions without due process of law in banning the man from engaging in business while he still owns the team or from being present at the events and practice sessions of the organization he owns. They might force him to sell under certain bylaws of the umbrella organization (the NBA), but I think they're stretching their powers and their necks a might bit thin. A good lawyer might make a lot of hay from all of this.

At the very least, the Colored People will demand a refund of the money already spent planning this now canceled party to honor Mr. Sterling.
