NLRB: We will continue to act despite the Appeals Court decision

Mark Gaston Pearce, chairman of the National Labor Relations Board, issued the following statement in reaction to today’s DC Appeals Court decision that President Obama use of recess appointments to install three people on the NLRB last year was unconstitutional. The action renders the board without a quorum to act and potentially invalidates a year’s worth of actions and rulings by it. Pearce indicated that the NLRB will attempt to continue on regardless:

That’s nowhere near as bad as what the gun grabbers are attempting to do to prevent legitimate gun companies from conducting legitimate financial transactions.

The natural progression and consequence of the GOP going left.


There have always been Rockefeller Republicans but I really believe a lot of this is “conservative” blue dog dems moving under the GOP tent as the Dem Party went all out commie. That was the straw that broke the elephants back, IMO.

Pearce should then be thrown into jail for violating a court order. And Zero should be put on notice not to try anything funny.

Imagine the media howls if Bush had tried this! "Constitutional Crisis" would be the headlines along with "breathless" top-of-the-hour reports on ABCCBSNBCCNN.

Boehner and "high ranking Republicans" are part of the problem. The House should be de-funding agencies left and right at this point and waging all out fiscal war. Instead, Boehner replaces CONSERVATIVES in key rolls and bashes Republicans harder than he does democrats.
Boehner is bought and paid for, he IS part of the problem.

I am very happy I read this post of yours.

The radio station to which I usually listen, and carries Mark, will shortly be breaking away and covering the local hockey game. I must now go over to a more distant station to get Mark’s take.

This is the point where the judiciary needs to stand
up and say, “No, you will not act despite our ruling
and if you attempt to do so will find yourself in
contempt of court, and all decisions reached by you
since THE RECESS are null and VOID!”

The Second Amendment contemplates the same result but with a slightly different remedy.

Ok, so the judicial branch of government acted and the legislative branch of government acted (by the Senate remaining in session). The President and the bunch of socialist union scum bags at the NLRB are going to ignore 2/3’s of the government. So what is the recourse? When I read our constitution I get stuck at the 2nd Amendment for the answer.
