FORMER DIRECTOR’S CALENDAR RELEASED UNDER OPEN RECORDS LAW, BUT REQUEST FOR CURRENT DIRECTOR’S CALENDAR “DENIED IN ITS ENTIRETY”
On July 23, 2011, The Post & Email mailed a request to Loretta Fuddy, Director of the Hawaii Department of Health, under the state’s open records, or UIPA, law.
Our request was received by the Hawaii Department of Health on July 28, 2011 and responded to on August 3, 2011 as having been “denied in its entirety.” The reason for the denial given was “Director Fuddy’s personal calendar is not a government record within the scope of HRS §92F-3, See OIP Opinion 04-17.” The calendar was sought because a member of the public had been told that Fuddy was “on leave” and had “left the island” when calling to inquire as to whether or not Fuddy intended to comply with a subpoena issued by the U.S. District Court in Honolulu in relation to the lawsuit Taitz v. Astrue. The Post & Email was told by an Oahu resident acquainted with certain employees in the Health Department that Fuddy had been gone for a few days but had been in her office during the weeks of July 18 and July 25, 2011.
On August 8, 2011, Taitz and two document experts arrived at the Health Department but were denied access to Obama’s original birth certificate and instead given a letter stating that the documents requested would not be produced for inspection, citing “privacy” laws.....

She’s legit in the fact that it says a federal subpoena allowed the inspection. It appears that Hawaiian officials have violated a subpoena.

“Seems to me - if the “personal calendar” of any state employee is kept/maintained on equipment paid for by the citizens of that state - it by default becomes a “public” record and subject to inspection.”
Seems to me the calendar would be similar to an official timesheet or even travel vouchers for state business in that they are all accounting for the employee’s time and whereabouts. All of these types of documents should be public records as they effectively provide an “audit trail” of employee activities. Seems pretty straightforward to me.

That’s my point. Birthers believe that a federal court authorized Orly to inspect the documens. It didn’t. Just because Orly issued a subpoena doesn’t mean she’s automatically entitled to her request under the law. The state has a legal right to object to her request. (In fact, in this case, it has a duty to object.) It did. There is no “defiance” by the state. Orly now has to prove to the court that she’s entitled to her request. She will not be able to do so.

Trump the clown is a self promoter and was out generating publicity to increase ratings for his stupid TV program, and to generally draw attention to the Trump brand. The problem for Trump is the whole thing blew up in his face and made him look like the buffoon he really is.

I'd guess Orly knows perfectly well the dopey wild goose chase she is on will amount to exactly nothing. She's managed to turn herself into the birther queen now, and whether it be for money from contributions or just attention, Orly will keep this charade going till Hussein is out of office. None of these "investigations" into this supposed conspiracy, whether they be from Orly or Trump, will ever amount to squat.
