A military jury has convicted an Army doctor who disobeyed orders to deploy to Afghanistan because he questions President Obama's eligibility for office.

The Constitution does not say that.
Pretty amazing how newbies flock to this subject.
He has standing in his own case, of course. But not one about Obama's eligibility.
Lakin? Why would he have standing now?
Yep.
There's good reason this "two citizen parent" argument has received no traction whatsoever outside of the birther circus. It's a load of bunk. That's why nobody's buying it.
This is good for a quick mention on Fox, an irate column or two from some unknown Conservative blogger, and that'll be the end of it.
“Im hoping he gets to appeal or gets to simply choose retirement at his highest completed grade.”
I think Lakin is glad I’m a retired O-5, not an active duty O-6 on the CM.
“MAJ Dobson, the doctor who had to replace LTC Lakin on short notice, testified next. He recounted how two days after arriving in theatre, the unit suffered a mass-casualty attack, with sixteen wounded. He said that he was not, in his opinion, as well-prepared to deal with the attack as he would have been had he had longer to prepare for operations at the FOB. The defense suggested on cross that the deployment was probably a good career opportunity for the major personally.”
I’d be thinking maximum penalty right about now...and a Lt Col shouldn’t be as STUPID as Lakin.
Yep .. they keep coming, trying to work their
special Omojo... ;)
FYI
** Lakin report coming up on FNC with
Brett Baier now.

I say look for a demotion of rank and duties and maybe a discharge. Other than honorable and maybe even light duty at some hospital til he can retire. Maybe.
And I'm saying look for prison time and cashiering.
The Constitution doesn't define the word “is” either.
Fundamentally our experiment in self-rule depends upon the honesty and good will of the citizens dedicated to making it work.
The Constitution could be the size of the IRS code, with every possible term define in tightest legal language possible, and evil will still leak through. The most carefully crafted laws will **NEVER** corral evil.
Yes they were, but do you suppose for one second that they would have granted Natural Born Citizenship to a child born in this country with two foreign citizens parents?
I may have to spell it out for those that believe that anyone born in this country is a Natural Born Citizen but I am sure our Founding Fathers knew exactly what they meant to do when they made that the law of the land.
Which fact does NOT mean you can make up your own arbitrary definition and claim it's there.
I also feel sorry for “Conservatives” that think the military should “just follow orders” that ultimately come from an illegal alien.
You evade the distinction between “citizen” and “natural born citizen.”
Yes, but the other charges of disobeying a lawful order he plead guilt to. He says that he never received notice to deploy to anywhere but Ft. Campbell. And he cannot use the president’s birthplace as grounds to appeal.
I agree that Lakin made a mistake in judgment. However, it was a mistake on principle. It was not criminally negligent. Nor was it malicious.
His intent was a good purpose. (Whether one agrees with it or not.)
I would let him walk with a reduction. (He was on the O-6 list, iirc, and would have been promoted by now.)
The bottom line is that his punishment should be no worse than any others who miss movement for combat zone deployment. We could probably research what that is.
I'm glad you can admit that at least.
...but do you suppose for one second that they would have granted Natural Born Citizenship to a child born in this country with two foreign citizens parents?"
"granted" is not the right word, but yes. That was their understanding at the time. Birth in the country is enough. That was the way it worked in England for a very long time and the way it continued to work here as colonies, and as an independent nation.
"...I am sure our Founding Fathers knew exactly what they meant to do when they made that the law of the land."
Of course they knew. They were barring naturalized citizens, immigrants, from the Presidency.
