GOP Lawmakers, Some Dems Blast Justice Department Suit Against Arizona Law

The Obama administration is facing harsh backlash from several lawmakers today after filing suit against the state of Arizona over its controversial immigration law.

The Justice Department today filed suit against the state's law, which makes it a state crime to be in the country illegally, arguing that it unconstitutionally usurps federal authority to enforce immigration laws. Republicans and some Democrats say that while immigration is a federal issue, Arizona should not be punished for acting in response to the federal government's failure to meet its responsibility.

Rep. Lamar Smith (R-Texas), the top Republican on the House Judiciary Committee, and 19 other Republicans in the House sent a letter to Attorney General Eric Holder today saying that the suit against Arizona's law "reflects the height of irresponsibility and arrogance."

"Arizona has taken a reasonable, constitutional approach to dealing with a problem that has been ignored by the Obama Administration," the letter says. "This lawsuit reveals the Obama Administration's contempt for immigration laws and the people of Arizona. It reveals contempt for the majority of the American people who support Arizona's efforts to reduce human smuggling, drug trafficking and illegal immigration."

The Arizona law doesn't do any such thing as far as I can tell. Funny how the Justice Department can trump up a suit against AZ over illegal immigrants, but it can't manage to handle a clear case of voter intimidation by the so-called "New Black Panther Party".

It does not create a state crime but requires police to investigate violations of immigration law. Why don’t these people at least try to get their facts straight?

The law is NOT controversial...it EXACTLY mirrors the existing federal law. These lib writers really get fixated on a particular word or phrase. Exhibit B: UNEXPECTED.

Even in California illegal aliens who land in jail after being legally arrested for crimes (mostly drunk driving and domestic violence) are now handed over to ICE for deportation after their criminal cases are adjudicated. Maybe California should boycott Califoria.

Yep, in both cases the federal government is ignoring the law by cherry picking what Obama and his thug administration consider laws worth enforcing. It's clear they are not enforcing laws the American people think they should be enforcing.

Since the Arizona IS the Federal Law (with more protections for individuals) shouldn't Obama be suing himself? Shouldn't the opponents be out there calling for the repeal of the Federal Law?

Why don't they do this?

Answer: Because it is not about the laws, its about inciting ethnic hatred among Hispanics for Whites (ie the Republicans). Obama, the race-baiting community organizer is now Obama the race-baiting President. If anyone gets murdered due to this racial incitement, the blood is on Obama's hands. The man, his administration, his toadies, his zombies, his puppet media are all equally guilty.

BTW, as in all of Obama's policies, I predict more death and destruction.

All the AZ RATS are toast; perhaps more importantly this cannot help Reid or Boxer in their re-elections. I don’t care what the MSM says: independents and many Latinos are furious with this federal lawsuit.

From the article it appears that some Dem Reps in AZ oppose the action and says they (Dem Reps) are in tough re-election bids. This action by Obama is certainly not going to help them as their voters know the situation is out of control.

I realize that everyone is busy and you have to condense your news and information search by surfing certain trusted sources. However, this issue is important enough that I highly recommend that you take the time to read the original source documents and not rely on something your brother told you he heard from someone who really, truly "knows."

I happen to be a lawyer, but I think the issues in this matter are clear enough for the layman to understand.

The federal government through the DOJ is asserting its supremacy in the field of immigration policy. Never mind the fact that they have been incredibly ineffective and inactive in efforts to solve the problem. I think they have two difficulties:

  1. AZ is not trying to create immigration policy, rather they are trying to enforce their own police powers, an in doing so reference the Federal Immigration standards defining illegal alien status, and
  2. the failure of the federal government to do anything effective is palpable, demonstrable, and at some point this failure to protect the country because "we're working on it" is no longer sufficient excuse to preempt the field of law enforcement in this area from AZ's participation.

How about a Republican bill with funding for state police to patrol and make arrests near their international borders? Let the dims vote on that in the next Congress.
