An Army doc who refuses to go to Afghanistan until President Obama produces a birth certificate will face court-martial.
Lt. Col. Terry Lakin, a decorated military man who has become a part of the fringe "birther" movement - which believes President Obama was not born in the United States - could face a dishonorable discharge for failing to obey orders, MSNBC reported on Tuesday.
The 18-year veteran came out in support of the largely discredited conspiracy theorists at the end of March, proclaiming he would "disobey" his "illegal" orders to deploy.
"I believe all servicemen and women, and the American people, deserve the truth about President Obama's constitutional eligibility to the office of the presidency and the commander in chief," he said in a video statement posted on YouTube on March 30.
The Bronze Star Medal recipient refuses to go to Afghanistan for a second tour until Obama releases his birth certificate showing he was, in fact, born in the U.S.
"Seeking out public office, especially the highest in our land, means you must uphold the Constitution, Mr. President, and confirm your eligibility," Lakin said in the video.
The Army doctor was informed of his court-martial by his brigade commander, and his Pentagon building pass and laptop have been seized, MSNBC reported.

My understanding is that these fine men and women do a lot of things at their peril.
Lt Col. Lakin trying to get this into court so that the judicial system can have a say in the matter. That's exactly how it's supposed to work. Other people have tried to do this for many months, but are typically told that they "have no standing".
The judicial system cannot act until someone with standing steps forward. Looks like Lakin may be the one.

I understand that you are saying that he presumably has standing and therefore can take his conviction to appeal before the federal courts. That may be true, but our man Obama may be long gone before this gets beyond the Court of Military Appeals and is considered by the Federal Appeals Court. Certainly he will have had to stand for reelection by then.
States must certify him for the ballot in 2012. They can refuse to do so until he produces the proper documents. He will sue them and the courts will rule. That’s the way to go with this.
Lakin is on a fool’s errand, and he is going to find out that alot of people will work very hard to ensure that the U.S. military stays out of partisan politics. Believe me, you do not want the military playing little reindeer political games.

Why in the name of Douglas MacArthur could not Col. Lakin have put his case in the words you used, instead of this Birth Certificate paper chase?
The BC is a damned red herring that only serves Team Obama and helps them misdirect the attention away from the primary issue, i.e., the man's father was not an American.
The Court Martial will attempt to avoid any discussion of eligibility, and concentrate on the military aspects of the case. I hope the Colonel is lawyered up for it.
I agree that it would be wonderful for the country to have the issue resolved, and for Obama to be found eligible, or not, ... but I am betting that just ain't gonna happen.
Officers in our military take an oath to uphold and defend the U.S. Constitution. Enlisted personnel do not. They are our last line of defense should the President issued an executive order that the protest in Washington on the 19th is a ‘national emergency’, declares martial law, and arrests the attendees as ‘domestic terrorists’. That really doesn’t sound so far-fetched, does it? It would be tough for any officer at that point not to consider the complicit acts of Congress to give that kind of power to the President, and consider joining other officers deciding to occupy Washington until special elections are held to replace Congress and the President. At that point they would stand down.
And the birth certificate is a canard. The issue is the law concerning children born of unmarried women (bigamous marriage not legal in U.S.) and her status to confer her citizenship if she is under the age of majority if the birth is overseas. If the birth was within U.S. jurisdiction, a different law may hold that she had insufficient residency to confer her citizenship at the time of birth, but that her child became naturalized several months after the birth. How the obvious civil law decision will play in military courts will prove to be interesting in itself. Will the military court request a decision from SCOTUS?
And the recent revelation of the Kenyan MP who specifically stated last month that Obama, Jr., was born in Kenya is not a fact lightly dismissed.
Sorry, but Obama is not Natural Born, and if no one has standing to question it, we are living in a tyranny. I for one am glad LTC Lakin has the testicular fortitude to risk his career over this.

Now as far as the other responses to my post go.
Obama became the LAWFUL commander in chief when he was sworn in. That is the point at which this particular tool became duty bound to follow all legal orders issued by him.
The SECOND he was sworn in he became CINC, the order to duty is a legal order ergo go the honorable thing to do is FOLLOW HIS FREAKING ORDERS!!! Not pull some publicity stunt and leave his unit a man down for a deployment to a war zone.

Saddens me deeply to say this, but yes. Yes, they very well, might.
It is not the way people want to go with this, but as time erodes, it looks like what will happen. Team Obama has successfully engineered a temporarily successful, anti-constitutional coup. Fortunately for them, so far the opposing legal teams have been distinctly bush league and easily outmaneuvered.(e.g., wasting two years in the wrong courts with the wrong plaintiffs., etc.)
I suspect that you are right, even if he was born in Hawaii which I think is the mostly likely venue of all those discussed ad nauseum. The problem is that the courts haven't ruled on what Natural Born Citizen means in the context of Presidential eligibility for those born on American soil of a Foreign national father. I think that the founders would say no, but what think the courts?
I am no expert on standing, but even if LTC Lakin is deemed to have it, he is going to be convicted on a charge of refusing a lawful order and he damned well should be.
This is a problem for the courts and they are running from it as fast as they can - the last thing in the world they want to do is to rule on this issue. But, that's what we hired them to do and we should demand that they do their duty.
Lakin's deployment orders were issued by the SecDef via JCS and Department of Defense, not Duh'bumba.
He is setting a poor example for the troops.
The motions now before the Federal District Court in Washington, D.C., to grant Writs of Quo Warranto can only be stalled for so long.
The quest for the documentation in Hawaiian Courts cannot be stalled for ever, because Hawaiian Law gives any citizen the right to see the documentation backing up the Hawaiians' absurd pronouncements of Obama's eligibility.
So, eventually, this question of Obama's eligibility will be resolved one way or the other. He will be gone by then. Not before the end of his term.
Let the lawyers handle this. We have to make sure our team has a PLAN, a PROGRAM, a LEADER, and some CLUE as to how to handle two years of reversal of disastrous and dangerous policies.
