Army Calls ‘Birther’ Doc’s Bluff

It's guts ball time for an Army surgeon who has vowed not to deploy to Afghanistan with his unit unless President Obama provides evidence that he's a "natural born" citizen of the United States.

In response to previously published statements by Lt. Col. Terrence Lakin, the Army presented an official letter of counseling that directs him to report to Fort Campbell, Ky., on April 12 to begin deployment preparations with his unit.

Ha. Well I didn't suggest the trolls can't be clever. I'm beginning to recall your activity from the past, but your question was a good one, one which others might have thought about asking so I was happy to answer it.

These are very serious issues. My family and pre-college children will have to live with whatever we don't do to reestablish our conviction that the principles of the Constitution are the foundation of our legal system. Even my wife questions the need for a hard number like 35 years as the minimum age for the presidency. Explaining why our framers made such and such a choice is not easy. Explaining why adherence to the meaning of the framers is also not easy. If society changes, the Constitution has several mechanisms for amending its articles. But some, Obama, Hughes, Arthur, decided that they were entitled to ignore rules because, as Obama said, they “don't allow me do accomplish what I think the country needs.” I hope you will employ your clever mind to insuring that your freedom to express yourself without fear is preserved. Observe Obama's friend and Bill Ayers son's employer, Hugo Chavez, insuring his kingdom for life by eliminating the last of the independent press. This is a deadly serious issue because we still have the most free nation in the world, and our society will resist tyranny by whatever means necessary. Obama is using the Cuban/Soviet model. He has created a schism between the very productive classes and the middle classes. His tax system does not differentiate small businesses, LLCs, which pay taxes as individuals, from the "wealthy" making over $250k/year. Those small businesses account for about 70% of private job growth. That is why private job growth is diminishing. Obama wants a revolution while he is commander and chief. Skilled Cubans came to the U.S. Where will skilled Americans go?

At some point, the administration needs to deal with this issue. They can’t stand by idly while career soldiers are willing to put themselves at risk for wanting to know the full truth about our putative commander-in-chief. So far, he’s left the HI DOH hanging out to dry to cover for his lack of compelling evidence of birth. Now we’re looking at the third military complaint to arise, with a good chance there will be more. The American people deserve full disclosure. There’s no excuse for hiding behind lies, half-truths and misinformation.

I hate to break it to you, but there is no reason to believe Obama wasn’t born in the US with an American mother. You can debate if that is good enough, but it was good enough for the American people (who elected him), the US Congress, and the Supreme Court.

If the LTC doesn’t agree, he should have put in his papers when it became obvious Obama was going to be installed as President. But he’s been taking the Queen’s shilling, so now it is time to do her bidding - so to speak. He had the option of getting out, but CHOSE not to do so.

No sympathy for him from me. Sorry.

He should be impeached, thrown out, and sent to prison.

Only Presidents, Vice Presidents and all federal officers may be impeached. To be President you must first be eligible. If he's not eligible, he's not President, although acting, de facto, as President, and thus cannot, and need not, be impeached. He can and should be thrown out and imprisioned though. For fraud if nothing else, but there may be an element of treason in his recent actions (giving aid and comfort to the enmies of the US). But that would be for a trial court to determine. Biden would probably pardon his a$$ anyway, while acting as President.

I hate to break it to you, but there is no reason to believe Obama wasn’t born in the US with an American mother.

There are a myriad of reasons. His mother's whereabouts at the time of birth are not documented. His step-grandmother says he is a son of Kenyan soil. His own wife says Kenya is his home country. Tammy Duckworth says he was born in Indonesia. Obama gave conflicting accounts about which hospital he was allegedly born in. The state of HI refuses to confirm that his alleged COLB is real. He has a certificate number that is most likely fraudulent. Hawaiian birth certificates are easily obtainable for people born out of state. What we have is little reason to conclude that Obama was born in the U.S. with an American mother. The evidence is sparse and uncompelling.

I think the possibilities range from: (1) his birth certificate, a legitimate one, cites his religion as Muslim because BHO Sr stated as much on the long-form BC; or (2) his mother relinquished his natural-born citizenship for him when he was adopted by his Indonesian stepfather

1961 Hawaiian long form birth certificates have no field for "religion", nor does any other US one I've seen.

By US law, a parent cannot forefite the citizenship of a child. Nor can the child renounce it themselves, until they reach a more mature age, generally 18, but in some cases younger if they can convince a US consol that they are not being influenced or pressured by anyone to renounce their US citizenhip. And the bar for that is very high.

I would just point out that this a fairly recent interpretation of citizenship laws. In the laws in effect at the time Obama would have been adopted by Lolo Soetoro, there was nothing in the law that specifically prevented a minor from renouncing his own citizenship. It's also not clear what effect an outgoing adoption can have on a child's citizenship. One state department Web site acknowledged that the United States couldn't protect the citizenship rights of children adopted into non-Hague Resolution countries, such as Indonesia. What I think might be more overriding however is if Obama chose to exercise any of his Indonesian citizenship rights as an adult. It's pretty hard to claim NBC-status under such a scenario.

Well, I had thought about logging in under another name. but that seems kinda cheesy, so I will just try to behave myself until this stuff passes. I like the idea of a TV series, and I may have to write a pilot myself. I need a good actor to play me; somebody like Harrison Ford maybe, or Clint Eastwood.

You know, somebody who catches the essence of my noble resistance to the evil, maniacal forces of darkness and paranoia, while preserving the manliness and sexiness of the warrior spirit that I exhibit. I see me, sitting there, playing my guitar, writing poetry, and studying the arcane arts of invisibility and astral projection as the online war between sanity and insanity rages on.

Occasionally, young un-tutored chicks come to my atelier/arsenal for instruction in poetry, Jungian archetypes, and certain uh er, uh “Tantric” things. There is the occasion casual affair. You know, kind of a conservative version of Billy Jack.

I return just in time to ward a vicious attack based on the typical mis-interpretation of an obscure irrelevant statute.

As usual, I throw myself into the fray and drive back the secret OBOTS, thus saving conservatism, democracy, Free Republic, and the Tea Party from embarrassment. Two women, who bear a passing physical resemblance to Sarah and Michelle, visit my studio, where we play with my guns. The Sarah look-alike is particularly impressed with the Mosin Nagent M44, and says, “All that time I spent looking out across the ice floes, I never realized there were weapons like this, so powerful -— so close.” Michelles goes ga-ga over the Belgian made Browning. I promise to write her a poem. We all exchange numbers. The episode ends.

Not really. WKA cites Minor in saying, “...all children born in a country of parents who were its citizens became themselves, upon their birth, citizens also. These were natives or natural-born citizens, as distinguished from aliens or foreigners.” IOW, this is a universal principle for naturally recognizing citizens. Anything outside of this definition is no longer natural, because you have to have some sort of statutory construction to allow others to be citizens at birth. That's why WKA made a point about the parents being permanent residents ... to show that they had more than temporary allegiance to the United States. Such is not so with the child of a visiting scholar.”

Wong Kim Ark says a heck of a lot more than that, and has a devastatingly detailed section compared to the “minor” historical notation of Minor. You're either being disingenuous, or you don't know what it says.

The court you're thinking of intentionally avoided saying that Obama is an NBC. “

“Based upon the language of Article II, Section 1, Clause 4 and the guidance provided by Wong Kim Ark, we conclude that persons born within the borders of the United States are “natural born Citizens” for Article II, Section 1 purposes, regardless of the citizenship of their parents. Just as a person “born within the British dominions [was] a natural-born British subject” at the time of the framing of the U.S. Constitution, so too were those “born in the allegiance of the United States [] natural-born citizens.”

Yeah, they just avoided the heck out of it, didn't they? Of course, there is no actual sentence stamped “Obama is an NBC,” but anyone who can read the decision and claim that's a meaningful distinction is, again, being deliberately disingenuous.

Excellent reference. Is the Gordon essay available on the Web? I've searched and can only find the reference.

During the search I came across a useful site filled with quotable contrary information, information useful to trolls, which might benefit those of us who spend time correcting misinformation.

There are some valid references, but this resource authoritatively quotes a decision, Perkins v. Elg for example, and then makes false statements about the conclusions. It is morbidly fascinating. The site must presume the reader has not or will not read the decision.

Minor v. Happersett - yes, it’s been mentioned on FR but not fully hashed out. I don’t see how, if this was decided by the SCOTUS then they did indeed give a definition of the term NBC.

Because the case did not turn on that definition, it is dicta, just like everything else the Supreme Court has written or quoted, about the definition. It can only matter in a Presidential (or VP) eligibility case, as being eligible for President is the only time being a Natural Born Citizen matters. Since there have been no such cases, there has been no definition that forms a precidence for future courts.

Like the other cases, Wong does not explicity say who what a Natural Born Citizen is. It says who a citizen at birth under the 14th amendment is, but never says Wong is one. Furthermore the case did not turn on Wong being an NBC, merely a citizen, so all that verbiage, other than the 14th amendment referances, is so much fluff and dicta.

The Supreme Court never said or held Wong Kim Ark to be a natural born citizen. However, the silly judges in Indiana wrongly concluded Ark was a natural born as a legal and historical basis? Nice slight of hand on your citing that silly Indiana Ankeny v. Indie Governor case and not giving it credit:

Indiana: "we conclude that persons born within the borders of the United States are “natural born Citizens” for Article II, Section 1 purposes, regardless of the citizenship of their parents."

Funny that no other court has concluded this in over a hundred years since 1898 but these guys have...just plain ignorance.
