ORLANDO, FL -- Moments after Congress voted to approve President Obama's health care legislation, Florida's Attorney General announced he will file a lawsuit to declare the bill unconstitutional.
Bill McCollum will join Attorneys General from South Carolina, Nebraska, Texas, Utah, Pennsylvania, Washington, North Dakota and South Dakota to file a lawsuit against the federal government.
"The health care reform legislation passed by the U. S. House of Representatives this evening clearly violates the U.S. Constitution and infringes on each state's sovereignty," McCollum said in a statement distributed late Sunday night.
"If the President signs this bill into law, we will file a lawsuit to protect the rights and the interests of American citizens."
McCollum will hold a press conference at his Orlando office Monday morning to discuss his plans.
That was funny — at least I can still laugh tonight!
There is only one thing that needs to be taken out that will result in the whole bill collapsing, and it is the mandate to purchase government approved health insurance.
WOW. I have been advocating this for days.
And if that happens, the time has long since come for states to say, "Guess what, we don't care." It's time for we the people to say, "We don't care." We have been like frogs in a slowly heating pot of water for four decades. Now the water's boiling and if we don't hop out immediately, it won't matter.

Why do you think the Supreme Court will throw it out? On what grounds? Di you think they will refuse to hear from 38 states?

Hate to burst your bubble, but that is NOT a “PERSONAL” lawsuit. See the words “in his official capacity”? That’s the difference.
Our tax dollars will be used to defend all of those named individuals as he is suing them AS representatives of the Fed. Government - NOT as individual citizens.
Not saying this lawsuit shouldn’t go forward. Just that one should understand the difference between a PERSONAL lawsuit and one filed against an agent of the government.
CHECK NUMBER 7 in the complaint which reads as follows:
“Each of the defendants is sued in his or her official capacity only.”
Again, they are not being PERSONALLY sued.
Can you sue an agent of the government PERSONALLY for acting in his or her “official capacity”? I don’t believe you can. Would be interested in hearing how you would PERSONALLY hold these people accountable for real damages.
Sorry — we were posting “over” each other... I understand where you are coming from, I just thought there were laws to protect our elected officials from personal lawsuits of that sort. I am not a lawyer either — just trying to understand where you all are coming from in regards to the personal lawsuits. I can’t see how one could even be filed against any of them personally.
Anyway, please God something is done here with Obama-Care and the gov't takeover of college loans... otherwise, this country is doomed.

If we as private citizens of the United States of America are even willing to entertain the notion of the legitimacy of this legislation, and are too cowardly to accept the prospect of consequence of ignoring it on the basis of its violation of the enumeration of powers in Article 1 Section 8... then we must ask ourselves a penetrating question: Do we really deserve a free republic?

The Federal government cannot mandate that someone buy a product and if they don’t, fine and imprison them. This is not like SS or anything else that we have ever seen. Every resident of this country must buy government approved health care insurance. It is unprecedented.
