Courts can remove ineligible chief executive - Precedent cited in appeal (certifigate)

In the United States, courts can, in fact, remove a chief executive officer of a government if that officer is found to be ineligible, according to a court precedent cited in an appeal of a California lawsuit that challenges Barack Obama's legitimacy in the White House.

A multitude of cases have been brought over the issue of Obama's eligibility. Some are by critics who have doubts about whether he was born in Hawaii in 1961 as he has written, and others are from those who question whether the framers of the Constitution specifically excluded dual citizens – Obama's father was a subject of the British crown at Obama's birth – from being eligible for the presidency.

The disputes revolve around the Constitution's demand that the president be a "natural born citizen."

Now in an appeal of a state court case in California that named as a defendant California Secretary of State Debra Bowen, attorney Gary Kreep of the United States Justice Foundation is arguing that there already are two precedents that should be applied: one in a court case in which state officials removed from the ballot a nominee for president simply because he did not meet the Constitution's eligibility requirements.

"In 1968, the Peace and Freedom Party submitted the name of Eldridge Cleaver as a qualified candidate for president of the United States. The then-Secretary of State, Mr. Frank Jordan, found that, according to Mr. Cleaver's birth certificate, he was only 34 years old, one year shy of the 35 years of age needed to be on the ballot as a candidate for president," the brief, being filed this week, argues.

Hawaii became a state in August of 1959. If O was born before that date, he wouldn’t even be a US citizen, reagardless of parentage. Maybe it’s the birthDATE he doesn’t want known. That would also explain his failure to release all educational records - it would be the paper trail confirming he lied.

They tried that on Barry Goldwater in 1964 because he was born when Arizona was still a territory. The arguement didn't work then and won't work now.

If you think just canning - and possibly indicting - Holder is no big deal, especially if he turns on Obie, then we definitely are at cross purposes-

IF that ever happened, yes it would be a big deal, but turning on Obongo would happen right after hell freezes over. I don’t think Holder wants to sleep fishes, just like Rezko and Blago. They hint, but they aren’t going to spill the beans.

“Natural-born citizen” is no more defined in US Code than is
“to keep and bear arms.”

The latter wasn’t defined until the SCOTUS ruled on “DC v Heller” in 2008.

Are you using the Snopes or Fight the Smears defintion of “Natural-born citizen”?

That might be part of your confusion on this issue ...

That’s your problem, William. You’re getting it confused again.

It’s not about disproving Obama is/is not a Citizen.

It’s about his “Natural-born Citizen” status.

The AP reporter stated the following:

Kenyan-born US Senate hopeful, Barrack Obama, appeared set to take over the Illinois Senate seat after his main rival, Jack Ryan, dropped out of the race on Friday night amid a furor over lurid sex club allegations.

This report explains the context of the oft cited debate, between Obama and Keyes in the following Fall, in which Keyes faulted Obama for not being a “natural born citizen”, and in which Obama, by his quick retort, “So what? I am running for Illinois Senator, not the presidency”, self-admitted that he was not eligible for the office. Seeing that an AP reporter is too professional to submit a story which was not based on confirmed sources (ostensibly the Obama campaign in this case), the inference seems inescapable: Obama himself was putting out in 2004, that he was born in Kenya.

The Supreme Couort has long since held that the constitutional requirement for presidential ineligibility is not controlled by laws of citizenship and it’s certainly not affected by immigration laws. You do not seem very well informed.

Unless you are prepared to say that the Federalist Society citizenship experts, Heritage Foundation scholars, every federal judge, the Hawaiian government, snopes, factcheck and the USSC all in on this conspiracy or are that they all stupid.

I guess then you believe that Phil Berg and only those like him know the truth?

I will **NEVER** again trust the integrity of the conservative media to fully report the truth.

Rush, Beck, Hannity, Coulter,Levin, OReilly, Malkin, Medved...and the rest of the Fox stable of yappers.

All these guys and gals are essentially running personally businesses. Just as businesses depend upon the integrity of their brand name, these guys and gals have ***RUINED** their “brand name” for integrity and honesty in reporting the truth!

I am complete disgusted with the lot of them!

He really won’t be neutered since he has no problem with just appointing Czar after Czar thereby concentrating ALL of the power in the Executive Branch (Himself) and by-passing the House and Senate. He has friends in both the House and Senate right now so he can pretend he is acting constitutionally but if he is outnumbered this type of tyrant will use his backup plan. Make book on it. CO

Yes, it is arrogant!

An honest man would be **HONORED** to promptly prove with the **best** and **all** evidence available that he was a **natural born** citizen and eligible to be president and Commander in Chief of our troops.

That he has worked so hard to prevent the release of documents that nearly all citizens must produce ( even to play Little League) at various times in our lives suggests that he is lying treasonous criminal!
