Courts can remove ineligible chief executive - Precedent cited in appeal (certifigate)

In the United States, courts can, in fact, remove a chief executive officer of a government if that officer is found to be ineligible, according to a court precedent cited in an appeal of a California lawsuit that challenges Barack Obama's legitimacy in the White House.

A multitude of cases have been brought over the issue of Obama's eligibility. Some are by critics who have doubts about whether he was born in Hawaii in 1961 as he has written, and others are from those who question whether the framers of the Constitution specifically excluded dual citizens – Obama's father was a subject of the British crown at Obama's birth – from being eligible for the presidency.

The disputes revolve around the Constitution's demand that the president be a "natural born citizen."

Now in an appeal of a state court case in California that named as a defendant California Secretary of State Debra Bowen, attorney Gary Kreep of the United States Justice Foundation is arguing that there already are two precedents that should be applied: one in a court case in which state officials removed from the ballot a nominee for president simply because he did not meet the Constitution's eligibility requirements.

"In 1968, the Peace and Freedom Party submitted the name of Eldridge Cleaver as a qualified candidate for president of the United States. The then-Secretary of State, Mr. Frank Jordan, found that, according to Mr. Cleaver's birth certificate, he was only 34 years old, one year shy of the 35 years of age needed to be on the ballot as a candidate for president," the brief, being filed this week, argues.

Huh? I haven’t spent more than an hour on the issue before today. Doubt I’ve made more than a dozen comments other than snide jokes about the half-American, half-assed Kenyan wannabe tin-pot dictator.

We have lots of people on FR. Some are more interested in one issue than another. We do not all have to concentrate on the same identical issue. We cover a lot of bases on FR. You go ahead and cover the bases of your choice and allow others to cover theirs.

The form that the DNC used to certify Obama as their candidate only certified his ‘natural born American citizenship in Hawaii, in ALL the other states, that statement is missing.

In other words, the DNS ONLY certified Obama as their candidate, the DNC did NOT certify him as ‘natural born’ in 49 of the 50 states.

This possibly was to reduce the culpability of teh DNC for filing false certification.

The DNC either did not exhaustively investigate Obama’s citizenship or they did investigate it and decided that he would win the election and therefore they hid his ineligibility because they didn’t think they could win with another candidate or they themselves were so corrupt (Marxists/Socialists) that they wanted their Manchurian Candidate to win.

Sure, Dr. Orly makes mistakes. We all do. But Dr. Orly is no dummy. How many of us could go to a foreign country, learn 5 languages, establish a successful dental practice, a successful real estate business AND pass the California state bar- one of the hardest in the U.S. to pass?
She may be a ‘mail order’ attorney and not a Harvard lawyer, but she IS an attorney with all the rights and privilages of a Harvard lawyer nevertheless!
The point is; she has the passion, the zeal, the courage of her convictions and the love of America and its freedoms (unlike many of our ‘great’ attorneys and ‘patriots’ who criticize her) that will not let her give up!
She is exhausted. She is nervous. She is frustrated. It is reported that she gets by on 4-5 hours of sleep per night, and her family is very worried about her health- as well as her safety.
She makes mistakes. But she will NOT give up. She will keep on until she gets it right.

Your comparison is silly. Truthers are morons. There are holes big enough to drive a semi through in Obongo's past. He has hidden so many things, any normal person would ask why. One incident, like the passport breach, ah, chalk it up to coincidence. Too many coincidences begin to look like evidence and there are so many. None of his past makes sense. There are too many inconsistencies. If someone checked your past, would yours have an abundance of gaping holes and inconsistencies? Mne wouldn't and I'm not posing as president. He's a fraud, a big fraud. Liar, fraud, usurper, idiot. What is the scar on his head that keep showing up in pictures?

So would I, but the fact that he continues to fight it so hard, makes me very suspicious. I also think it's arrogant and rude of him to not produce it when every poll that you see on the internet shows that a huge percentage have questions and doubts regarding this issue. Why not just show the long form? I think he can't. For what reason I don't know. It could be something as minor as an embarrassment, or much more. We deserve to know. We have a right to know. He works for us, he is not our ruler.

I agree the Black Panther case is important but all it will do it get Holder canned. Obongo will blame it on Holder, Holder will resign. Big whoop.

These kind of things concern me more:

In a preview of the State of the Union address, President Obama has recommended a plan to help students pay off their debt – with taxpayer dollars, of course.

As Politico reports:

The Obama-Biden Administration will make student loans more affordable by limiting a borrower’s payments to 10 percent of his or her income above a basic living allowance. It will also keep the total cost of loan repayment manageable by forgiving all remaining debt after 10 years of payments for those in public service work and 20 years for all others. The monthly payment for a single borrower earning $30,000 who owes $20,000 in loans would be $115 a month, compared with $228 a month under the standard 10-year repayment plan.

Got that? College graduates saddled with student loan debt who decide to go into “public service work” will have their debt forgiven after 10 years. And if they do anything else, like join the private sector, their debt will be forgiven in 20 years.

At this point, it’s not entirely clear what type of “public service work” would qualify an individual for this deal. But as it stands, the public sector is appealing enough to college graduates. According to USA Today, the number of government employees taking in six-figure salaries has exploded, and the growth of these big-shot salaries has pushed the average federal worker’s pay to $71,206, compared with $40,331 in the private sector.

If you think just canning - and possibly indicting - Holder is no big deal, especially if he turns on Obie, then we definitely are at cross purposes.

This isn’t true. Both parents are not required to be US citizens. This is why this “birther” stuff is so dangerous. Misinformed, well-intentioned people are chasing after moonbeams while important stuff is ignored.

Is the Federalist Society, Heritage Foundation, every federal judge, the Hawaiian government, snopes, factcheck and the USSC all in on this conspiracy or are they all stupid? Is it that Phil Berg and only those like him know the truth?
