Doug Hoffmann in NY 23 says he is within 2000 votes! Count should be done by Thursday!

Doug Hoffman just told Glenn Beck they are 2000 votes behind in NY 23with 10,000 absentee votes left to count.

This is NOT over.

Fred Grandy was a fine Congressman and an even better ship’s purser, but he’s wrong on this one. By seating Owens, the House judged Owens to have won the election, and thus he was a legal member of the House when he voted on Obamacare.

Thanks for your considered post -- the thing is, I wonder that so many people here are truly unaware of how many members of the House have been seated throughout the years based on projected win alone, no certification from the state issued? Sure, this was a special election to fill a vacated seat, but how many times have you seen the returns announced, people are sworn in, yet the total counting has not been completed? I know I've seen it occur many times, the only reason this one is causing such a furor is that is was one district rather than results from many all over the country, specific, pointed attention, also the whole Scozzafava farce.

Hoffman conceded, the Dems seated the projected winner, if a contested race results from these absentee votes, then the House will tolerate a re-count ... guess who'll get the most votes, the seat??

It certainly would. But, what if the Democrat scu*bags refuse to accept the different outcome and engage in shenanigans? (I fear they will and just might get away with it.)

How do you know that?....... Where are you getting your info that they were mostly military. I read one article about the county where Ft. Drum is located and they had something like 2300 absentee ballots mailed out and about 1300 returned.

Article I of the Constitution provides that each House is the sole judge of the qualifications, elections and returns of its members. The House can seat whomever the House rules won the election, even if the state has certified someone elese as the winner—that was quite common in the 19th century, and it happened in 1985 when the Democrat-controlled House pretty much stole a seat when it seated Democrat incumbent Frank McCloskey despite the Setate of Indiana having certified his Republican opponent as the winner (the House had its own “recount” and ruled, on a party-line vote, that McCloskey won the election by 4 votes).

It is certainly strange to see someone seated so quickly in a relatively close race in which the vote-counting hadn’t been concluded. Under the Constitution the House can rule that Owens is the winner and thus seat him, and in cases in which a candidate is up by 10% with 97% of votes in it probably wouldn’t raise an eyebrow, but Republicans really dropped the ball here by not objecting to Owens being seated until the votes had been counted. Also, Hoffman’s campaign got some terrible advice when it was told that he should concede on election night.

I concession speech is a ceremonial courtesy - NOTHING MORE. It has no legal bearing whatsoever.

Has everyone forgot about the two districts that reported zero votes for Hoffman. This was blamed on the new electronic voting machines. It seem that should be some remedy there if there was any chance that it could have changed the election results.

Oops- It was actually 3 districts. I’ll bet the way those machines were set up really made sure that Hoffman did not get many of the votes that were coming to him.

He needs 60% of the absentee ballots left uncounted to win. That’s a pretty tall order but is not an impossibility.”

If you are correct that’s better than the 75% figure I saw mentioned earlier.
60% with heavy military ballots is quite doable.

Doug Hoffman—if you are listening—for next election some advice. Go to the gym and tone up some-— and lose that puny, geek bespecled look. Project your voice with confidence of your conservative convictions and nail that Pelosi lapdog liar, fraud Owens next year.
