Doug Hoffmann in NY 23 says he is within 2000 votes! Count should be done by Thursday!

Doug Hoffman just told Glenn Beck they are 2000 votes behind in NY 23with 10,000 absentee votes left to count.

This is NOT over.

I expected this kind of thing in NJ and yet it happened in NY. I was confident that Hoffman had won because the polls all showed him ahead and then this.

Conklin indicates that all of the ballots in this race will be counted and that the NYS Board of Elections will declare a winner when that vote count is completed, sometime in December.

As Jude Seymour at the Watertown Daily Times pointed out this morning, “It’s mathematically possible that Douglas L. Hoffman could pass Rep. William L. Owens when all absentee ballots in the 23rd Congressional District race are counted...”

Bill Owens’ campaign was aware of how close this race would be and had pre-emptively ordered the votes impounded to prevent Doug Hoffman being sworn-in immediately if the preliminary results went Hoffman’s way.

If the vote goes to Hoffman, the Board of Elections says that Owens “will have to be removed.”

This, of course, is not the first time this has happened. In a 2006 California election for the House, House Speaker Dennis Hastert pre-emptively swore-in the presumed winner long before the result was certified. Legal filings at the time suggest that this action is tantamount to the Speaker canceling the election and choosing their own candidate as until the result is certified, the election is not over. By placing an unofficial winner in the House, the Speaker is removing that decision from the hands of the people.

So NY may declare Hoffman the winner and PelosLIE may not seat him. PelosLIE’s approval ratings are already at about 12% - are they going to go to single digits over this and how will this play out in the heartland - since this was farm country and PelosLIE is basically strong arming them if she decides not to seat Hoffman and circumvent New York State’s own official certified results and the will of NY 23.

How BRAZEN will Nancy PelosLIE be about this?

Is she willing to risk a national scandal involving this one seat?

Pretty interesting set of political choices and murky waters ahead for PelosLIE and company.

The plus side is that the Democrat party is looking more and more like totalitarian communists - and that will get them killed in 2010, when you will not see close votes anywhere in red districts.

For a recount? Are you kidding? If Hoffman were UP by 2,000 votes he'd still lose the recount. "Optimism" is the guy standing around while the 'rat machine stuffs the ballot boxes. You've seen this movie before. The ending ain't gonna change.

I think the recanvassing has brought him this close. The closer he gets the better.

Better for NY 23.
Better for Tea Partiers.
Better for Palin, Beck, Armey and Limbaugh.
Better for Conservatives fighting other RINO attacks.
Better for Rubio in FL.

The RAT party and media narrative is being given the lie. They are communists, complete with propaganda, and the country is starting to see that very well.

That is a good thing, whether Hoffman is seated now or in Nov. 2010.

I hated Commies when I was a kid many years ago and I still hate Commies to this day. I knew I was a Republican when McCarthy went after Commies. I knew the ruthlessness of Stalin and anyone who hated Commies was a friend of mine and I’ve never changed one bit.

So let’s us control this story for once. Let’s get the word out. Let’s question results. Let’s question the ‘authority’ of the tyrannical PelosLIE.

Let’s not ‘stand’ around as you so unceremoniously put it.

The closer Hoffman is, or if NY somehow certifies him and PelosLIE has to spend some of her precious little political capital to keep Owens in office - that is a good result.

Now it’s on to 2010 - where many people I know will not be standing around on corners either (with all due respect.)

Yep, Thune lost to Tim Johnson by 524 votes with the help of the Native American shennigans. The really funny thing is that, had he beaten Johnson, Daschle would have retained his seat two years later. So it actually worked out pretty well.

..."The bad news, however, for now-hopeful Republicans/Conservatives is that when the results of the Busby/Bilbray race were contested by a California voter, the Republican-leadership of the U.S. House Administration Committee sent a letter [PDF] to the CA judge in the case, arguing that neither CA voters nor the state courts had jurisdiction to contest the election any longer, once the candidate had already been sworn into the U.S. House.

  "The Court should dismiss this action," Paul Vinovich, Republican counsel to the House Admin Committee wrote to Superior Court Judge Yuri Hoffman. "State courts do not have jurisdiction to decide an action contesting the election of a member of the United States House of Representatives. That power is textually committed to the House of Representatives itself by the Constitution, a commitment that has been recognized by the Supreme Court."

  "The United States Constitution unambiguously states that 'Each House shall be the Judge of the Elections, Returns, and Qualifications of its Members,'" Vinovich argued, quoting article I, section 5 of the Constitution. "As a result, the Constitution gives the House of Representatives 'the authority 'to determine the facts and apply the appropriate rules of law, and, finally, to render a judgment which is beyond the authority of any other tribunal to review.'"

  "When plaintiff asks this court to decree following a recount '[t]hat the candidate with the most votes be judged elected,' plaintiff is asking the Court to issue an order that the House of Representatives is bound by the FCEA [Federal Contested Elections Act] not to honor," Vinovich instructed the judge in his letter.

  On the House Republicans' assertion of the Constitutional argument that it was the Republican-led U.S. House of Representatives --- not the CA courts and not the voters in the state --- who had jurisdiction over the results of the election at that point, the judge accepted the argument and dismissed the case. Democracy was denied. The argument withstood appeal to a higher court, essentially, as time wore on and the court found the complaint to be moot. Of course, we were outraged at the time that any candidate would be sworn in before all votes had been counted, that the House of Representatives would argue that neither the people of California's 50th district in San Diego, nor the courts of this state, would be allowed to determine their own Representative in Congress, and that the court was willing to accept what seemed such a patently absurd argument.

  Nonetheless, the Republicans were successful in shutting down any and all state challenges and contests to that election --- simply through a speedy swearing-in ceremony. An appeal to Congress itself, under the FCEA would have been decided by the Republican majority, just as such a contest today would be decided by the Democrats who now enjoy the majority. The Republican candidate from 2006, Rep. Brian Bilbray, elected on illegal voting systems, installed under an official vote count, with results that were never allowed to be challenged with a manual count, still sits in the U.S. House today.

  Given where the New York race could be headed, Democrats would be wise to remember that 2006 precedent so strongly argued by Republicans, and Republicans would be wise to remember it's never a good idea --- no matter how much it appears to be politically advantageous in the short-term --- to put partisan politics ahead of the small-d democracy of we the people..."

—Actually 10,000 were distributed...I believe the actual numbers of absentee which came back in was around 5800.

**I’d heard the same thing. However, Hoffman himself said there were 10000 left. Beck also mentioned that today is the deadline to receive military ballots. I’d doubt that they would have gotten 4200 more ballots after the last report, but Hoffman’s mentioning of 10000 surprised me.

Who gave the 5800 figure? Recall CNN (and Fox) declared Owens the winner even though there were more absentees than the then margin of victory.

How many times do we have to re-learn this lesson?

There's a WORLD of difference between Hoffman and Gore.

I chalk up Hoffman's early-concession to his inexperience as a NON-politician. God bless the citizen who is a non-career statesman wishing to serve his country.

But Gore's concession — and then un-concession — stems from Gore trying to FULLY utilize the Democrat election machine in Florida, trying to game the system for Gore in true chad-like form ...

i honestly do not believe any one of the rat castard commies actually has won a vote in many cycles...by 'playing nice' and allowing it to continue, we are sealing our fate...

Good points all - someone looking at the BIG picture.

Furthermore, it sends chills down the spines of vulnerable RATS, even if the MSM ignores, discounts, or suppresses the information.

And it is also an ongoing disruption for Pelosi and her henchmen.

3 of the voting machines showed Hoffman got 0 votes. This was inaccurate for some reason???? Wonder why???

Guess this was the only way the Dem’s could push the vote towards Owens so that they could swear him in quickly. At the time these 3 machines counted him at 0, the lead was over 5,000 maybe even 5700? Can’t remember. That was with 93% of the vote in. So, Hoffman conceded! He should not have.

The count was fixed with those 3 machines as well as the remaining 7% being counted which is probably where the count now stands with a little over 2000 votes difference. Absentee ballots sent out over 10,000. They have until today to receive those ballots that are postmarked no later than November 2.

Does that help?
