That caveat is what worries me. It says they won’t be prosecuted by the Justice dept, but once they give the names to the private prosecutors, watch out!

He isn't going to flagrantly violate that one aspect of the US Constitution that prohibits against ex post facto prosecutions.

It is an acceptable human interrogation technique which invokes panic and makes prisoners spill the beans.It is very effective, which is why Obama wants the practise ended.
Obama wants to be the only one able to use such interrogation techniques. ANd he will likely do much worse before the end of his sordid political career.
