Soldier doubts eligibility, defies president's orders

A U.S. soldier on active duty in Iraq has called President Obama an "impostor" in a statement in which he affirmed plans to join as plaintiff in a challenge to Obama's eligibility to be commander in chief.

He will be court-martialed and tossed out...I was a military brat-count on it-I hope he escaped Leavenworth. The people who encourage soldiers to do this should be sent to Leavenworth...no matter what we are at war.

You do not understand the law.
The Supreme Court NEVER said that Obama was qualified.
The Supreme Court NEVER takes action on its own, it can only rule on legal actions begun by others.
The Supreme Court has only ruled that those taking legal action did not have “standing” -—
And, I think this guy IS a hero, in every sense of the word.
You, Alberta, are encouraging cowardice, and that is not what made this country great.

Imagine if some soldier had done the same in light of the 2000 election. But I’m just engaging in intellectual consistency, a resource in short supply around here.

I agree with you. I am a military brat...both parents in Navy-born at Great Lakes...my brother and sis were Marines...this soldier will most likely be court-martialed and/or tossed out of the service...he could end up at Leavenworth.

Well, politically speaking, one might demand that, but politics are not legally binding.

What I mentioned, up above in Post #7, would make it legally binding. That is being done in the states of Oklahoma and Arizona.

The reason why Obama has not had to produce it, is that it has not been a legal requirement. All he had to do to qualify was to have his party, his campaign and himself sign statement affirming that he was qualified. But, there was no legal requirement to produce documentation.

And that’s why this “political requirement” is going nowhere right now. No court will enforce something that is in the political sphere, when there is no law that says someone has to produce a specific kind of documentation.

Yes, because those in authority have done nothing, I feel ALL of you in the military are defending a country, half of which does not, even remotely, deserve it.

Your “jumping on a hand grenade” analogy is superb! I can’t help but wonder how many other patriots in the military are of a like mind. Obama may be facing mutiny should he attempt to use the armed forces to enforce his agenda. One can only hope.

I admire the Lt's gumption and willingness to stand for his beliefs and dedication to support and defend the Constitution.

I also think you will be shown to be correct. Hussein was sworn in as President. The orders of his superior officers are legal. His mere presence in any unit, especially a combat one would be detrimental to morale.

His life may well be ruined to find the answer to a question that few want to know.

I know that there is a certain group that engages in “Obama Derangement Syndrome” — who don’t like any opinions other than their own, and this is the typical answer...

Someone pointed out on another thread that a court-martial is unlikely in this case . . . mainly because the Obama administration doesn’t have the same control over a military court than a civilian one. They will not want to run the risk of having a military court issue an order for someone to produce the document in question.

From what I recall of the UCMJ, a court martial could do exactly that. They could also find the officer not guilty in the (likely) event that the White House failed to produce such a document upon request. Obama cannot afford to have a military officer openly questioning his authority, particularly if that officer then gets away with it at a trial.

Article 90. Subsection 2.

“Any person subject to this chapter who—

2) willfully disobeys a lawful command of his superior commissioned officer; shall be punished, if the offense is committed in time of war, by death or such other punishment as a court-martial may direct, and if the offense is committed at any other time, by such punishment, other than death, as a court-martial may direct.”

(2) Disobeying superior commissioned officer.

(a) Lawfulness of the order.

(i) Inference of lawfulness. An order requiring the performance of a military duty or act may be inferred to be lawful and it is disobeyed at the peril of the subordinate. This inference does not apply to a patently illegal order, such as one that directs the commission of a crime.

(ii) Authority of issuing officer. The commissioned officer issuing the order must have authority to give such an order. Authorization may be based on law, regulation, or custom of the service.

Therein lies the rub. His orders do NOT come from the President, they come from his commanding officer.

There is no good side to this, and a Courts-Martial is inevitable.

He is brave and a patriot, but he is also terribly misinformed of his standing in this issue.

We ask our military to sacrifice life and limb all the time.

It seems to me that this brave man has made a choice, and that choice will probably NOT get him killed, though there will be a price to pay.

Agreed, “standing” is problematic. However, what if this officer forces a SUPERIOR officer to take the same action? Or a Military Court to take the same action?

By the way, there have been PLENTY of military members who have protested against sitting Republicans.

Seems to me that John Kerry even met with our communist enemy, while Kerry was still a member of the Naval Reserves!

I agree. Too bad. I had to produce my birth certificate a couple of times, and I have no problem producing it now. Omama is an imposter but it will never get out.
