Perdogg, it could only be speculation, unless HIPPA rules were broken and medical records of the baby have been released to journalist.

I think the answer is to be found in the Newsweek cover story:

Over the weekend before the convention, campaign aides made the uncomfortable decision to urge her to go public with her unmarried 17-year-old daughter's pregnancy in order to rebut salacious Internet rumors that the teen was actually the mother of Palin's own newborn child. An aide, speaking anonymously because the matter is sensitive, says that Palin and her husband grew angry about the allegations. "Do I have to show them my stretch marks?" she asked one campaign official..

The NYT is going to expose Palin's unsightly stretch marks!

The bar is high because they’d need to prove malice. Does anyone HERE doubt malice? Alas Freepers aren’t a legal venue. I wonder if they could use Alaska as a venue. With her current 86% approval rating you might get the truth past a jury there.

The theory may be that at some point, Sarah will throw up her hands and say “as much as I would like to be VP, having my family trashed with utterly baseless but vile scurrilous charges every day on the front page of all the major newspapers in this country and on the TV and cable channels is too high a price to pay.”

Not gonna happen. Sarah took hits from both sides of the aisle in Alaska, and she's the one still in office.

HIPAA violation would not be against the New York Times. It can only be used against the medical provider, or someone that has the medical information for business purposes and divulges to someone else without a need to know. Rumors, or second hand accounts are not HIPAA violations.

For example, I work in medical billing. If during the course of my work I find out you have an STD, and I tell your wife, without permission, that is a HIPAA violation. But if I see you if a grocery store, and you tell me that you have an STD, and I turn around and tell your wife, that is not a violation, that is just gossip.

So in this case, the NYT would not be in violation, but whoever told them could be if they originally got the information from medical records.
