U.S. Announces Indictment Of International Arms Dealer for Conspiracy to Kill Americans and Related Terrorism Charges
NEW YORK—Michael J. Garcia, the U.S. Attorney for the Southern District of New York, and Michele M. Leonhart, the Acting Administrator of the U.S. Drug Enforcement Administration (DEA), announced today the unsealing of an indictment against international arms dealer Viktor Bout, a/k/a Boris, a/k/a Victor Anatoliyevich Bout, a/k/a Victor But, a/k/a Viktor Budd, a/k/a Viktor Butt, a/k/a Viktor Bulakin, a/k/a Vadim Markovich Aminov, for, among other things, conspiring to sell millions of dollars worth of weapons to the Fuerzas Armadas Revolucionarias de Colombia (the FARC) — a designated foreign terrorist organization based in Colombia — to be used to kill Americans in Colombia.
Bout was arrested by Thai authorities on a provisional arrest warrant on April 9, 2008, based on a complaint filed in the U.S. District Court for the Southern District of New York, charging conspiracy to provide material support or resources to a designated foreign terrorist organization. Bout has been in custody in Thailand since March 6, 2008. According to the indictment unsealed today in Manhattan federal court:
Bout, an international weapons trafficker since the 1990s, has carried out his weapons-trafficking business by assembling a fleet of cargo airplanes capable of transporting weapons and military equipment to various parts of the world, including Africa, South America and the Middle East. In 2004, as a result of his weapons trafficking activities in Liberia, the United States Office of Foreign Assets Control within the Department of Treasury placed Bout on the Specially Designated Nationals list, which prohibits any transactions between Bout and any U.S. nationals, and freezes any of Bout’s assets that are within the jurisdiction of the United States.
Between November 2007 and March 2008, Bout agreed to sell to the FARC millions of dollars’ worth of weapons — including surface-to-air missile systems (SAMs), armor piercing rocket launchers, AK-47 firearms, millions of rounds of ammunition, Russian spare parts for rifles, anti-personnel land mines, C-4 plastic explosives, night-vision equipment, “ultralight” airplanes that could be outfitted with grenade launchers and missiles, and unmanned aerial vehicles. Bout agreed to sell the weapons to two confidential sources working with the DEA (the CSs), who represented that they were acquiring these weapons for the FARC, with the specific understanding that the weapons were to be used to attack United States helicopters in Colombia.
As described in the Indictment, during a covertly recorded meeting in Thailand on March 6, 2008, Bout stated to the CSs that he could arrange to airdrop the arms to the FARC in Colombia, and offered to sell two cargo planes to the FARC that could be used for arms deliveries. Bout also provided a map of South America, and asked the CSs to show him American radar locations in Colombia. Bout said that he understood that the CSs wanted the arms for use against American personnel in Colombia, and advised that the United States was also his enemy, stating that the FARC’s fight against the United States was also his fight. During the meeting, Bout also offered to provide people to train the FARC in the use of the arms.
The Indictment unsealed today charges Bout with four separate terrorism offenses:
Count One: Conspiracy to kill United States nationals;
Count Two: Conspiracy to kill United States officers or employees;
Count Three: Conspiracy to acquire and use an anti-aircraft missile; and
Count Four: Conspiracy to provide material support or resources to a designated foreign terrorist organization.
If convicted, Bout faces a maximum sentence of life imprisonment on each of Counts One through Three, including a mandatory minimum sentence of 25 years’ imprisonment for Count Three. Bout faces a maximum sentence of 15 years’ imprisonment on Count Four. The case is assigned to United States District Judge Shira A. Scheindlin.
The United States is actively pursuing Bout’s extradition from Thailand. Mr. Garcia praised the investigative work of the DEA and thanked the Royal Thai Police, Office of the Attorney General for Thailand, and the Royal Thai government for their assistance. Mr. Garcia also thanked the Romanian Border Police, the Romanian Prosecutor’s Office Attached to the High Court of Cassation and Justice, the Korps Politie Curacao of the Netherlands Antilles, and the Danish National Police Security Services, for their cooperation, and thanked the U.S. Department of Justice Office of International Affairs.
“Viktor Bout has long been considered by the international community as one of the world’s most prolific arms traffickers,” said U.S. Attorney Michael J. Garcia. “Today, Bout is in Thai custody facing extradition to the United States, where he will be prosecuted for agreeing to arm a terrorist organization, an aim of which was to kill American citizens.”
“Viktor Bout no doubt faces some of the most extraordinarily serious conspiracy charges possible for his crimes against Americans,” said DEA Acting Administrator Michele M. Loenhart. “With the unsealing of this indictment, we are one step closer to ensuring Bout has delivered his last load of high-powered weaponry and armed his final terrorist.”
Assistant U.S. Attorneys Anjan Sahni and Brendan R. McGuire are in charge of the prosecution.
The charges contained in the indictment are merely accusations and the defendant is presumed innocent unless and until proven guilty.

Colombian Paramilitary Leader Extradited to the United States to Face U.S. Drug Charges
WASHINGTON –Carlos Mario Jimenez-Naranjo, a.k.a. Macaco, has been extradited from Colombia to the United States to face drug trafficking charges, Assistant Attorney General Alice S. Fisher announced today. Jimenez-Naranjo faces drug-related charges in the District of Columbia and the Southern District of Florida. Jimenez-Naranjo made his initial appearance today in the District of Columbia before Judge Alan Kay.
Jimenez-Naranjo was indicted in the District of Columbia for conspiracy to manufacture and distribute five kilograms or more of cocaine, with intent to import cocaine into the United States, and with engaging in drug trafficking with the intent to provide something of pecuniary value to a terrorist organization (narco-terrorism). The indictment also includes a forfeiture allegation. If convicted, Jimenez-Naranjo faces a minimum prison sentence of 20 years and a maximum of life imprisonment. Pursuant to the extradition request, however, the United States has provided assurances to the government of Colombia that it will not seek a life sentence, but instead will ask for a prison term. The defendant is also charged in the Southern District of Florida in a 20 count indictment with conspiracy to import cocaine, money laundering offenses and conspiracy to possess with intent to distribute cocaine on board a vessel subject to United States jurisdiction. Jimenez-Naranjo will first face trial on the charges in the District of Columbia.
Before his arrest, Jimenez-Naranjo was allegedly one of the top leaders of the Autodefensas Unidas de Colombia (AUC), a Colombian right-wing paramilitary and drug-trafficking organization. The AUC is a U.S. Department of State-designated foreign terrorist organization. According to the indictment, Jimenez-Naranjo led the Bloque Central Bolivar, a group within the AUC, commanding an estimated 7,000 armed combatants. Jimenez-Naranjo controlled large areas where cocaine was produced, and his organization was responsible for exporting thousands of kilograms of cocaine from Colombia to Central America, Mexico and the United States. In August 2007, Jimenez-Naranjo was served with a provisional arrest warrant based on the indictment in the District of Columbia.
An indictment is a formal charging document notifying the defendant of his charges. All persons charged via an indictment are presumed innocent until proven guilty.
The charges in the District of Columbia will be prosecuted by attorneys assigned to the Criminal Division’s Narcotic and Dangerous Drug Section (NDDS). The charges in the Southern District of Florida will be prosecuted by the U.S. Attorney’s Office for the Southern District of Florida. The investigation in this case was led by the U.S. Drug Enforcement Administration with investigatory assistance from FBI and U.S. Immigration and Customs Enforcement (ICE) in the Southern District of Florida case. The extradition of Jimenez-Naranjo resulted from the cooperative efforts of the government of Colombia and the Criminal Division’s NDDS and Office of International Affairs Sections.

New Iranian Surface-To-Surface Missile Found In Basra
Iraqi Defense Minister Abd Al-Qadir Al-Ubaydi said May 4 that Iraqi army searches in Basra turned up a new surface-to-surface missile.
Reliable Iraqi intelligence sources said that the missile was an Iranian Falaq 1, made in 2007, and that this was the first missile with such great destruction potential to be found in Iraq.
The sources said that if many such missiles had been brought into Iraq, “we are on the brink of a security catastrophe, both Iraqi and regional.”
Hinting that the missile could have been sent from Iran together with a launch crew, the sources added that the launching of such missiles required great technical knowhow, and that at this point the militias were not likely to have such knowhow.
The sources also noted that Hizbullah used similar Iranian missiles in the July 2006 war against Israel.

Pakistani senator Mushahid Hussain Syed said on May 6 that the new Pakistani administration was determined to bolster relations with Iran regardless of U.S. pressure.
Hussain Syed told the Iranian news agency Mehr that “The new government is very interested in expansion of ties with Iran. All parties, including the People’s Party, want relations with the Islamic Republic.”
He added that “Nuclear program and relations with China and Iran are all to our national benefit,” and that Pakistan does not care about the U.S. interests in this regard.

Coalition Forces Capture 13 Militants, Disrupt Insurgency

WASHINGTON, May 7, 2008 – Coalition forces apprehended 13 militants and disrupted insurgent operations yesterday in Afghanistan’s Paktia province, coalition officials reported.
The troops searched compounds in the Zadran district as part of an operation to disrupt the Haqqani terrorist network, which has trained militant fighters, stockpiled weapons and built explosives in the area, officials said.
In the course of the operation, one suspect suffered a head injury while resisting coalition troops. He was treated at a coalition hospital. In addition, several AK-47 assault rifles, ammunition and ammunition vests were confiscated and destroyed or removed.
Also yesterday, coalition forces identified three insurgents detained last month in Afghanistan’s Khowst, Helmand and Zabul provinces.
The insurgents, identified as Rahman Gul, Mullah Ikhlas and Mullah Salim, were apprehended during three separate operations targeting anti-government militants.
Salim, also known as Daru Khan, was detained April 14 during operations in Qalat district, Zabul province. He conducted attacks against coalition forces and civilians, coalition officials said.
Ikhlas, also known as Abdul Khaliq, was detained April 14 in Garmser district, Helmand province. A militant facilitator and financier, he was found in a compound that held two U.S. AT-4 anti-tank weapons, a rocket-propelled grenade and two rifles, officials said.
Gul was detained April 20 in Bak district, Khowst province. As a member of roadside-bomb cell, he led attacks against coalition forces, officials said. He was captured in a compound where RPG warheads and boosters, a mortar base plate and ammunition were discovered.

Coalition Forces Kill Terrorist Leader, Detain 23 Suspects

WASHINGTON, May 7, 2008 – Coalition forces killed a wanted terrorist and detained 23 suspects in two days of operations targeting terrorist cells around Iraq.
Coalition forces targeted the wanted terrorist during an operation west of Balad, about 50 miles north of Baghdad. The man refused to comply with an interpreter’s instructions and, perceiving hostile intent, coalition forces engaged and killed him. The terrorist was a leader in the al-Qaida in Iraq network in Salahuddin province, coalition officials said.
Another wanted man, believed to be part of the same network, was detained with an additional suspect in a separate operation in Beiji, about 100 miles south of Mosul.
Coalition troops captured two wanted men during operations in Mosul. One suspect, believed to be an al-Qaida leader responsible for coordinating attacks against coalition forces, was injured when the door to the target building was breached, officials said. The suspect was treated on site and taken to a military medical facility. The other wanted man was detained for allegedly conducting bombing attacks against coalition forces.
Farther south, coalition forces captured a wanted man in Tikrit and three additional suspects believed to be tied to al-Qaida in Iraq leaders in Diyala province. In an area 95 miles southwest of Mosul, coalition forces detained six people suspected of working with multiple al-Qaida networks.
“We are taking al-Qaida in Iraq networks, their leaders and operatives out of circulation so the Iraqi people can continue to make progress toward a secure future,” Army Lt. Col. Maura Gillen, a Multinational Force Iraq spokeswoman, said. “Terrorists who conduct vicious attacks against innocent civilians have no place in the future Iraqis have chosen for their country.”
The capture of the 14 suspects came a day after insurgents in northeastern Baghdad fired three 122 mm rockets into central Baghdad, injuring seven Iraqi civilians and two Iraqi policemen in a mid-day attack that damaged a police station and community park.
The insurgent attack came about 12 hours after coalition troops detained nine suspects after noticing suspicious behavior while conducting a late-night operation in southern Baghdad. Among those detained by Headquarters and Headquarters Company, 4th Battalion, 64th Armor Regiment, troops is “a known criminal responsible for indirect fire attacks in Baghdad,” coalition officials said.

TIKRIT, Iraq – An operation for two known insurgent leaders resulted in over 20 Iraqi males being detained, May 7.
The operation was conducted in the Khatoon district of Baqubah during the early morning hours.
“The unit had gathered intelligence that indicated two high-level insurgent leaders were in the home,” said Maj. Mike Garcia, spokesperson for Coalition forces in Diyala.
“When they entered the home shortly after midnight, they found over 20 Iraqi adult males – awake – with several illegal weapons and a notebook containing plans for future attacks against Coalition forces in the home,” said Garcia.
Many of the men claimed to be students, local farmers or local media.
“We’ll identify these (individuals) through further questioning and if it is determined they are not involved in insurgent activity, they’ll be released,” said Garcia.
