I also don’t know these details, but I do know that the abortion industry is VERY anxious not to recognize the killing of an unborn fetus as murder, or even as a crime, because it tends to throw a bad light on abortion.

Where they run into trouble is that obviously the mother did not “choose” to murder her child in these cases. So it’s not a woman’s choice. But calling it murder still makes them very uncomfortable, because it suggests that maybe the fetus is a human being.

“Viability” was talked about a lot here in Summit County.

An unborn what?

Hmm. That’s what I thought they said.

I don’t get the distinction between aggravated murder and not. Any help here?

In aggravated murder, the victim is twice as dead. In just plain old everyday garden variety of murder, the victim is only half as dead. /s

No, I'm not a lawyer, and I didn't stay at a Holiday Inn last night.

I asked my hubby the lawyer......he said “aggravated” means “special circumstances involved”.

His last name is CUTTS.
Also, a spell check would give you ‘aggravated.’
I looked at this headline in Breaking News several times before realizing what this story was about....

I thought he looked like a liar on the stand. Until the trial, he claimed he had nothing to do with her death, but had to modify his “truth” after hearing all of the testimony against him.

A cop no less!
To think that this piece of trash was actually carrying a gun enforcing the law! hrmph! Disgusting.
Should be held to a higher standard!

Hope he’s hung by the neck until dead...slowly...very slowly.

Can someone explain to my cleaning lady how he was, in effect, found guilty of premeditated murder on the fetus, yet not on the mother? Did he intend to murder the child but not the mother?

(Couldn't believe she asked me that. Totally stumped me.)

Cancel # 24. Now I remember who he is. For a few minutes there I was trying to figure out if he was an NFL football player embroiled in a fight outside some night club.

Did he intend to murder the child but not the mother?

Yes. In order to return a guilty verdict on aggravated murder, it must have found that he had purpose and design in killing the child.

I haven't really followed the case all that closely, so I don't know the facts well enough to say, but someone mentioned as a possible reason (and it makes sense to me) is that when he killed the mom, had he called for help rather than hiding the body, the child would have lived. The jury could have inferred that because he made no effort to help the child, he intended to kill it.

I have no idea if that was the jury's thought process.

That is because they belong to the Father of LIES. They know it is a baby but they still want the mother to have the choice in killing it. That’s why I loathe O Bomb A he voted against child born alive act. I would spit in his eye! He sickens me.

I think post 13 clarifies that...in that after he murdered the mother, he had time to call for help and doctors could probably have saved the baby. Since he did not, the baby also died. That makes it the more serious charge because there was intent, in essence, in the case of the child.

I am so glad that verdict was found. How cruel can a person be who just lets a woman lay dead who is 9 months pregnant, long enough to also lead to the death of her child. He is sick...sickening and selfish. Hope your cleaning woman understands the difference now.
