Developing...Bobby Lee Cuts found guilty of murdering his wife, but not aggrivated murder. Found guilty of aggrivated murder of his unborn baby.

Sorry, it is Cutts, not Cuts. And I believe Davis was the mother of the unborn baby, but they were not married. There are other charges being read now.

I am not sure, either. I think a verdict of "murder" carries a lesser sentance than "aggrivated murder," but how they make the distinction is a legal thing. When all the verdicts are read I am sure they will be posted on FOX.

This fellow was real "cool" during the trial, and worked hard to appear penetant. At least he didn't fool this jury like OJ did!

"Aggravation is a concept in law, which Black's Law Dictionary defines as: "Any circumstance attending the commission of a crime or tort which increases its guilt or enormity or adds to its injurious consequences, but which is above and beyond the essential constituents of the crime or tort itself." For example, aggravated assault is usually differentiated from simple assault by the offender's intent (i.e., to murder, to rape etc.), the extent of the injury to the victim, or the use of a deadly weapon. An aggravating circumstance is a kind of attendant circumstance and the opposite of an extenuating or mitigating circumstance, which decreases guilt."

GLenn Beck has someone on who makes the distinction. Aggravated means something worse than muder due to what he did to the unborn.

The scumbag contended it was an accident. That in his attempt to leave her house, his elbow came into contact with her throat and caused her to fall down.

They were not married but, she had a child with him previously. He was also married with I believe two additional children. A real role model for society.....

Aggravated murder is Ohio’s version of first degree murder. It requires purpose and design.

Murder, on the other hand, is killing without such design.

I was just listening to that. So he is on the hook for the death of the child as far as the death penalty is concerned.

In practical terms I think it means that, even had he not meant to murder the pregnant woman, had he called a frikkin’ ambulance instead of hiding the crime, the unborn child would have most likely survived.

I am happy the unborn baby was viewed as a person as well.

Thanks, all of you for the clarification. So the murder of his lover was "unplanned," but because she was pregnant, they consider that the murder of her caused the death of their unborn child, so that child's murder was considered "aggrivated." That means he is subject to the death sentance for the murder of the child.

There are some other charges for which he was found guilty also, I think one was "endangering the life of a child."

Whatever, he will get what he deserves. It never surprises me that these people who don't get married, have multiple partners and children, lie, and live immoral lives always think they can get away with worse crimes. Society is full of them today. Nothing is sacred, nothing is beyond them doing. They have no self-discipline, no value for life. EXCEPT their own - they will do anything, say anything to save their own skin. Disgusting.

Yes...for sure. The woman was 9 months pregnant. Tell me how that is considered murder versus the planned abortion of a baby less than 3 months not being considered murder??? I never could understand the way people rationalize that a life is not a life from the moment of conception on. This verdict might help the "Right to Life" movement.

Can anyone recall what the verdict was for the death of the baby of the Peterson couple a few years ago?

Has anyone ever publicly questioned NOW, or NARAL, or any of these other murderous operations, when a guilty of murder verdict is returned against the killer of an unborn child?

Is there anything in the public record on this? Or are they stonily silent?

I do know when the state legislature in Kentucky wanted to change the murder laws to further encompass unborn children, feminists/abortion activists protested, saying that it was opening the door for prosecutions against abortion doctors. As for the public record of NOW or NARAL, I am unsure.
