Texas Talks Tough on Illegal Immigrants

The Lone Star State has long welcomed Latino immigrants, no matter how they got across the state's 1200 mile border with Mexico. Back when California voted to cut public services to illegal immigrants, then-Texas Gov. George W. Bush was preaching that illegal immigrants were equal players in the state's economy. But the atmosphere has changed markedly in Texas, home to about 10% of the nation's illegal immigrants. Now, a growing chorus of Republicans and some Democrats is pushing some of the harshest immigration-related measures in the United States -- laws that would not only deny public services to illegal immigrants but strip their American-born children of benefits as well. "The Texas bill could be a vehicle to get this before the courts, and we strongly support that," said Ira Mehlman, a spokesman for American Immigration Reform, which has been pushing Congress to revisit the Fourteenth Amendment. "There's no question that it's time for a review, given the number of people entering the country illegally and giving birth."

"A pregnant illegal can wait at the border, check into a hospital in Texas, give birth without paying a penny, and be rewarded for her illegal behaviour,"[State Rep.] Berman said. "That's outrageous."

To clarify the effect on the citizenship of an individual of the individual's birth in the United States.

IN THE HOUSE OF REPRESENTATIVES

January 3, 2001

Mr. STUMP introduced the following bill; which was referred to the Committee on the Judiciary

--------------------------------------------------------------------------------

A BILL
To clarify the effect on the citizenship of an individual of the individual's birth in the United States.

Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled,

SECTION 1. BASIS OF CITIZENSHIP CLARIFIED.

In the exercise of its powers under section 5 of the Fourteenth Article of Amendment to the Constitution of the United States, the Congress has determined and hereby declares that any person born after the date of enactment of this Act to a mother who is neither a citizen or national of the United States nor admitted to the United States as a lawful permanent resident, and which person is a citizen or national of another country of which either of his or her natural parents is a citizen or national, or is entitled upon application to become a citizen or national of such country, shall be considered as born subject to the jurisdiction of that foreign country and not subject to the jurisdiction of the United States within the meaning of section 1 of such Article and shall therefore not be a citizen of the United States or of any State solely by reason of birth in the United States.

This is all that has to be passed on the national level. No amendment to the Constitution, no state laws. This is it.

It is outrageous. However, the law should still be that any human born in the United States is an American citizen, jus soli. More effort should be put into stopping illegal entry, but any American born human is still an American.

It really is outrageous, but we, Americans, are such kind hearted people, that others will take advantage of U.S. if we, Americans, allow it. Allowing 'it' doesn't stop the behavior of an illegal criminal invaders from taking advantage. The illegal criminal invaders say, "it's my baby's birthright", and thus far we, Americans, have allowed the illegal criminal invaders to continue taking advantage. It's our own fault, yours and mine, for allowing criminality to be the first act of a 'newborn'! Any society will falter from that type of interior pressure! This type of criminal behavior should be ended immediately, if not sooner!

It just died in committee. They were afraid to bring it to the floor, as I recall.

So they let the situation get infinitely worse.

I'm sorry but you are out of your mind. You don't reward unlawfulness. These illegals are invading our country. Name one town that has been improved by the influx of illegal aliens. Hint there aren't any. The 14th amendment is clear. The original writers clearly stated that it was not to allow the children of aliens to become citizens. This clarification is needed and much overdue. Our country is under attack and we need to take a stand before be become a third world country. This is how the Romans fell.

"The Romans fell" because they became too dependent on the Germanic tribes immigrating in while not encouraging those Germanics to assimilate (and promising them land and then not giving it to them). From a Christian view, it is apparent that the Roman Empire lost its usefulness. It served as an incubator for the spread of Christianity, and once that was largely fulfilled, it was time to convert the barbarians.

What could those American citizens do to stop their alien parents from illegally crossing the border? Kick?

Where do you find that a child of an alien is not a citizen? In contrast the very first sentence states: "All persons born or naturalized in the United States, and subject to the jurisdiction thereof, are citizens of the United States and of the State wherein they reside."

That's sort of the point. You, and others, are focusing on the parents--who are criminals, and you choose, either willfully or accidentally to figure that comment 5 is also about the parents (the "reward" of which you and others type). Comment 5 is about the anchor babies.

Those families can be sent back to Mexico, but those children--when they grow up, are orphaned, etc.--are entitled to full American citizenship. They can come back; they can vote in state, local, and federal polls; and, if they choose, they can run for President.
