Second man charged with abusing Hulett's victim

January 14, 2006

BURLINGTON, Vt. --The young girl who was the victim in a child sex abuse case in which the perpetrator got a minimum sentence of 60 days also was abused by a second man, authorities have alleged.

That revelation is the latest twist in a controversy surrounding Judge Edward Cashman's sentencing of Mark Hulett. Hulett, 34, of Williston, had pleaded guilty to sexually assaulting the girl from the age of 6 to when she was 10.

Derek Kimball, 33, of Hinesburg, whom authorities describe as a friend of Hulett's, was arrested in October and is charged with sexual assault on a victim less than 10 years of age, and lewd and lascivious conduct with a child. He was later released on $25,000 bond and a series of conditions, including that he not contact the victim or any girls under the age of 16.

(....break...)

Court papers in Kimball's case say the girl told investigators that both Kimball and Hulett had sexually assaulted her in a number of separate incidents.

Detectives met with Kimball at his job at the Chittenden Solid Waste District in South Burlington on Oct. 7, according to court papers. During the interview, Kimball acknowledged the abuse and was arrested, according to the detectives' accounts in the court affidavit.

The law frowns upon retribution, but when the victim receives no justice, what then? How are people to trust in the justice system when the victim isn't considered, as is apparently the law in Vermont?

Oh... and Hulett's friend is out on bond. The girl told the truth, he admitted it - and he's out of jail with strict warnings not to go near children.

Is it wrong for me to wish someone imposes their own "justice" on these 2 monsters, who raped a 6 year old girl until she was 10, and finds themself before another judge who rules that they acted because the law did not protect them, as it is supposed to by the Constitution... case dismissed?

Cashman's ruling gives pedophiles a pass in saying that their crimes aren't terribly serious, and nothing REALLY bad will happen to them should they find themselves in his courtroom. He may has well have put out a welcome mat to pedophiles on the Vermont border.

Hulett and friend are "white trash" and according to liberal sentiment in Vermont, need to be rehabilitated. Howere a teacher who has sex with someone under 16 gets royally nailed under the same charge: Last year, two Chittenden County educators were sentenced in criminal court for having sex with underage students. Richard Bugbee Jr., a former coach and math teacher at Essex High School, was sentenced to serve four to seven years in prison. Jamie Lee Rugg, a former Milton High School drama teacher, received a six-month prison sentence. ,b> Sentencing in this area is all over the map in Vermont. Whether one gets a maximum sentence or a tap on the head, depends on how much liberal political correctness is offended. What Hulett did is far more egregious than what Bugby did. Go figure.

"The media coverage has been criticized by some who have studied the case. Republican Rep. Michael Kainen, a lawyer and the ranking member of the Judiciary Committee in the Vermont House, said Friday, "If it were accurately reported, I think there would have been a little less furor."

What was possibly "inaccurately" reported that would excuse a 60 day sentence for this scumbag? It sounds like Rep. Kainen needs to go too if he has the bad judgement to think that was a just verdict. It's great comfort to know he's the ranking member on the Judiciary Committee. /s

Would someone please explain the relationship between the girl and the first freak? Where was mom during all this? Where was dad?

The law frowns upon retribution, but when ...

Since when, and what's your authority for such a statement?

Retribution/punishment is one of the foundations of the justice system's basic reasons for incarceration, along with protecting the public from future crimes and along with rehabilitation.

It's a legitimate stand-alone basis for punishment and incarceration, in fact it's the moral basis for incarceration, whereas protecting the public is the practical basis.

It seems to me that Cashman has some personal reason to be sympathetic to the molesters, if you know what I mean.

Last night, while watching Animal Cops, my ten year old asked me how it can be that someone who abuses an animal can get up to a year in prison, while a man who hurts a child for years only gets 60 days.

My daughter is smarter than this judge. I think HE is a pedophile.

Anyone checked NAMBLA to see if Cashman is a member?

The entire Vermont establishment wants this to just go away. They don't want to be courageous, which would mean impeaching the judge and driving him from the Bench in disgrace. They just want to let his term expire, or hope he'll resign.

In a sense, they're now his partners in depriving this young girl of justice.

O'Reilly's had people on all week discussing the case, and he's FURIOUS! He said he will not stop unless the Vermont legislature removes the judge immediately. And he's also proposing a boycott of Vermont.

Did you mean "vigilantism" instead of retribution?

he's out of jail with strict warnings not to go near "children."

That should make parents feel better. Strict warnings - yeah, that'll work for pedophiles.

According to this article:

Hulett was a friend of the victim's family and frequently stayed in her home. The victim's parents were aware that Hulett had an interest in the girl and that the two, on some occasions, slept in the same bed, court documents said.

That's the part of the story that I keep looking for. Haven't heard anything about his relationship to the girl or how he had access to her for four years.

What did the parents mean that they were aware he had an interest in their daughter? This whole thing just sounds sick.
