Day 4: Hearing Resumes
This morning, Senators will question Judge Alito during a third round. They will then go into a closed session, to review the FBI background investigation on the Supreme Court nominee. Outside witnesses may be called to testify this afternoon, as well as the American Bar Association, to discuss its recommendations.

Anything outrageously outrageous from the RATS today? Mostly same stuff. Feingold asked about recusal from cases coming from 3rd Circuit, since 3rd Circuit Judges are going to testify on Alito's behalf in this hearing; and Schumer had a question about a specific case where Alito did not recall why he distinguished it from a similar one.
Alito is doing excellent again today. Make that "Excellent" with a capital "E".

Schumer knows he can't give a constitutional argument. If Alito gave a constitutional argument which might past muster, it would be giving a plaintiff in a future case a hint as to how to sway him to their point of view.
