I have created a website with the sole purpose of gaining support for my cause to achieve "Lawful Permanent Residency" (Green card) in the USA. I hope to achieve this by having a ”relief of” bill submitted to a Congressman and have it presented in Congress. By becoming a ”Lawful Permanent Resident” in the USA I will be able to fullfill a dream, namely to enlist in the US. Army.

So, in other words, if he's motivated enough to go through normal channels, i.e. finding a sponsor or actually talking to a military recruiter, he can do it. Otherwise, all he's doing is pushing for some special back-door status for himself through political means.

(Retired Army, with plenty of foreign-born friends who joined us over the years.) ;)

YES, once you are in the military, you are eligible for NATURALIZATION. That is not the issue here.

You CAN NOT join the military before IMMIGRATION.

So, if Wooley can't IMMIGRATE, he can't join the Army and nor qualify to be NATURALIZED.

So, 1rudeboy, your homework now is to look up the capitalized words in the dictionary.

I'd rather you refer me to the immigration lawyer with whom you spoke (private reply ok). If that is not possible, then I strongly recommend that you run the information I posted past him or her.

The if seems to be Wooley's problem. He's not a LPR at this time and that is what he's trying to accomplish so that he may join the Army.

If he were already in the country seeking a "Green Card", wouldn't that make him an illegal?

Please refer to I.N.A. 329(a)(1), which reads:

[if] at the time of enlistment, reenlistment, extension of enlistment, or induction such person shall have been in the United States, the Canal Zone, America Samoa, or Swains Island, or on board a public vessel owned or operated by the United States for noncommercial service, whether or not he has been lawfully admitted to the United States for permanent residence . . . . [emphasis added]

I should probably add that I am not advocating illegal activity.

Referring to my own comment #50, I take it to mean that he (or she) could arrive here on a student or tourist visa, walk into a Recruiting Office without unpacking, and sign right up. Full disclosure: I am not an immigration attorney.

And I'm not either. I don't know whether he's in any of those specified locations either but if he's not and is still in Sweden it wouldn't apply as I read it. That seems to be what he is saying but who knows for sure.

Well, I dont think that will work -- He would need to show birth certificate, drivers license, high school diploma, fill out paperwork and lie about himself. Wooley is simply trying to things the legal way.

I have several friends who would like to come to the US, but chances of getting a visa are extremely slim.

Now on the other hand, I know of a person here in the US that came here illegally and managed to get a "green card", how he got it is beyond me, but I suspect it may have involved bribes.

Actually his best bet is to come here on a tourist/student visa, find a citizen girl and get married to her. Then prove to the government, that he didnt marry just to get a visa.

I think it is sad that we make it hard for good people to enter the country legally and make it easier for third world people to enter with the diversity visa programm.

If it takes an act of congress, contact reps and senators offices in the area where you live and see what they say. They may do this all of the time. Making a website may not be productive.

Do you really have something like the French or Spain "Légion étrangère" in the US consisting of soldiers that are no citizens of the US? Never heared of that.

No the non citizens are in the same units with the citizens. All are American Soldiers, Sailors, Airmen or Marines. They wear the same uniforms with the same patches and rank insignia.

There may be higher concentrations of non citizens in some specialties and much lower concentrations in others. Non-citizens may not be able to get the required security clearances required for many military specialties.

I neglected to realize that if one is truly in Sweden, then the only information at one's fingertips is from the Army website, which appears to be incomplete. Moreover, phoning the U.S. Embassy in Stockholm just to speak with a faceless, low-level bureaucrat is no better.

Wooley's best bet is to find a qualified immigration attorney, and have a nice conversation about the information I've provided in my links above. Funny that the attorney will get the money for my legwork. C'est la vie.

No, he could be here on any of a number of types of visa. Tourist, student, or business for example.
