'The Fire' seems to be the focus a number of people have touched on here. A good number of them have included the right.

NicMarlo, I think you realize this. The others should too. If a conservative with a track record is lofted, how much criticism from the true right are the going to get?

Of course the answer is ZIP.

I said from the start, we should have gotten a nomination 90% of the right should have been able to coalesce behind and push. We didn't. This is what resulted.

I actually think if Bush had wanted Gonzales, he would have nominated him when O'Connor first announced retirement. While I am not sure that I trust Bush to nominate a better person this time, I don't think it will be Gonzales.

I believe the White House saw the handwriting on the wall when Republican senators began to discuss voting against her; pundits didn't make this decision.

Prayers for Ms. Miers & family, W, and our nation. The fear wasn't that the Republican Senators would reject Ms. Miers.

For her to win it would be the Democrats who voted overwhelmingly to confirm.

Lest we forget, Majority Leader Bill Frist and the overwhelming majority of his Republican colleagues were poised to defeat the unprecedented and frequently used (or threatened) filibuster tactics that had been unleashed against President Bush by the Democrats to weaken his appointment power.

The big media editorialized against it. George Will wrote at length (albeit unpersuasively) against it (see here and my response to him here). And Bill Kristol's favorite presidential candidate in 2000, John McCain, the leader of the Gang of 14, was all over the media making clear he would torpedo such an effort.

And that's exactly what he did. This in no way excuses the president's blunder in choosing Miers. But the ideological confrontation with the likes of Senator Charles Schumer and the Democrat left that many of us believe is essential, including Will and Kristol, was made much more difficult thanks to the likes of McCain and the unwillingness to change the rule before any Supreme Court vacancy arose.

This president has been poorly served by his Republican "allies" in this regard. Bush is the first president who has had to deal with an assault of this kind on his constitutional authority. And unless and until the filibuster rule is changed, a liberal minority in the Senate will have the upper hand.

Today the president would have to persuade seven of the most unreliable Republican senators to trigger the so-called nuclear option in order to clear the way for an up-or-down vote for, say, a Luttig. It is not at all certain or even likely that Lincoln Chafee, Olympia Snowe, and/or Susan Collins — the most liberal of the seven — would have voted for the Senate rule change for the purpose of confirming a solid originalist.

And it's likely the Democrat leadership would have succeeded in convincing at least some (if not most) of the seven Democrat moderates to oppose a rule change.

I have no doubt that this was part of the White House's political calculation. And it's possible the president didn't want to limp into this fight. That's no excuse. But McCain — who wants to be president and has now endorsed Harriet Miers — and his cadre must not escape scrutiny for their blunder.

Excuse me....but, I think that the pundits coming out the very first day just blasting her....put the Senators on "notice" that anyone that backed her was going to get similar "attention"....

Plus, the Senators job was to have the hearings, first in the Judiciary Committee.....they could have listened and voted her down...

Let us see, the next time the President to be careful should have Krauthammer, Frum, Brooks and Rich give her the religious litmus test. Then George Will, Howard Phillips, Pat Buchanan, Rush Limbaugh legal scholars all can give her the Constitutional knowledge test.

If he does that then he can contact McCain and the other RINOS and give his nominee the "moderate" test.

Who needs a Constitution? And who needs a President? Any old plebiscite of chosen cognoscenti will do.

what's a Mulligan? Frankly, when I heard the news this morning I sighed a big sigh of relief - hate to see the family fight - this is not the battle to fight over (conservatives among conservatives). I was neutral till the hearings, but just sick of all the gnashing of teeth. Let's hope GW's bold this time. If you heard Rush yesterday say what he would do now - it was awesome! Rush '08!

A handful at FR have opposed Miers nomination since the moment she got it. My own personal impression has been that their impetus was religious affiliation and little else.
