You may be right....I just got up from my "nappie" but while I was drifting off to sleep earlier, I wondered if there will be a 3rd justice leaving the Court before Bush's term ends. Haven't read through the rest of this thread so it may have already been addressed; just wondering if Bush is saving his fire for a third vacancy on the Supreme Court where he can appoint someone conservatives would really drool over.

Man 'o man, Bush and Miers are really catching Holy Heck and the hearings haven't even begun! I'm hoping she's a conservative we can drool over but I really can't get blood pressure up just yet (doctor's orders, doncha' know!).

Of course, once we learn more about her (or ANYTHING about her!), I may need to up the meds and the "nappies!" Or, maybe not.

If Bush had selected Charles Schumer for the seat there are some here who would defend it saying, "He must know something we don't."

Miers today doesn't trouble me nearly as much as what Miers shows every indication of becoming tomorrow: a roll-over liberal appeasing O'Connor clone.

Bush was going to have to fight this battle anyway. If he was determined to name a woman, he should have named Janice Rogers-Brown and let the Democrats beat themselves bloody against her nomination. America would have noticed the grave hypocrisy of the attacks and the Democrats would have paid for it in next year's elections.

And if the Democrats had succeeded in filibustering Rogers-Brown? Then Bush still could have nominated Miers.

He allowed the Democrats to avoid a vigorous self-bashing. Why?

That was really nasty for you to say since we all worked to get him elected and re-elected. Bush-bots can't stand any criticism of the man. I think it's ridiculous. He's a man, not a superhero.

Ms. Meirs' nomination came as a surprise to say the least. Her white house nomination statement regarding her strict application of the Constitution and rule of law are comforting. I do not have a detailed bio on the nominee to form an opinion.

I have to trust the President's personal knowledge of her qualifications and am willing to do that. I'm looking forward to the senate judiciary committee nomination hearing and Ms. Meirs' responses regarding her position on the different issues.

We can disagree, yes.

We can hottly debate and keep each other's respect.

I dislike it when a FReeper as above denigrates another with nothing to add to the debate. I dislike statements like this that would have never been made in person.

The good news is that we are debating ways to make this country better and not to tear it down like the otherside.

Even if the sole aim in filling the O'Connor vacancy was upholding the traditional war powers delegated to the chief executive-an admirable goal-regardless of how that justice might rule on a multiplicity of other controversial legal issues, there were still many, many other better potential nominees.

The assertion lacks specificity.

What is her interpretation of the 2nd amendment? 5th amendment takings? How big is the emanation of the privacy penumbra?

Let's see: Scalia, Thomas, Breyer, Kennedy, and Souter are healthy and show every indication of lasting another decade or more. That leaves Stevens and Ginsburg. Neither Stevens nor Ginsburg is likely to retire knowing that Bush would get to select their replacement. I just don't see that happening.

That's just talk. Talk is cheap. Whether or not she'll adhere to the Constitution is yet to be seen.

Tom Delay, the Hammer is quiet today. Miers did not donate to Delay or name him with others whom she said she supported when on c-span on 4/22/05.
