Roberts: Day Four Set to Begin

On Thursday, the members of the Senate Judiciary Cmte. continue with a third round of questioning. Then six different panels of out- side witnesses deliver their views on the professional and personal suitability of John Roberts to be appointed Chief Justice of the United States. This testimony will take the entire day.

I'm disappointed in Senator Coburn's questioning. He promised to determine if Judge Roberts is a strick constructionist, or at least to ask questions that would tend to discover that, and he did not do so.

See the transcript from Tuesday, near the end of the day, when Lindsay Graham asked him about strict constructionism. I think you will be pleased with the answer.

Roberts says issue is whether Congress has the autority whether under 14th Amendment Congress can abrogate the sovereign immunity of the State.

Kennedy thinks when people lives are concerned, that should be the only consideration, not legalisms which keep people from being helped.

...Apparently Massachusetts failed the victim in Kennedy vs Kopechne...

I agree Roberts is a gem of a nominee and makes these idiots look just like what they are.

My point is the nomination is NOT about Roberts anymore and the Dems know he will be confirmed. The Democrats will stall and stall as an afront to Bush because they think they have the "right" now as his poll numbers have dropped.

I hope I'm wrong, but still think more and more time will be asked and given and this nominee will not be seated by 10/03.

Kennedy is going on about affirmative action and saying Roberts was opposed.

Now says Roberts records on AA were in the Regan library and have become misplaced :)

Sorry Tator, but I do not agree. The RATS strategy is simple. Roberts replaces Rheinquist so he gets a pass. The fight will be over who replaces O'Connor. So why should the RATS shoot the proverbial load now?

They want another Souter to replace O'Connor. Bush is not going to give it to them. If the RATS fight now, the perception will be that no Republican chosen nominee for the court is good enough, which them gives what you say credence.

Bush will nominate someone equal to Roberts, use Roberts strategy and they will let the RATS try to Bork him. The Republicans are trying to paint the LIbs into a corner by trying to have Roberts come off as too conservative. Using that strategy, the Republicans can them put up a Luttig or Brown.

Kennedy wants to know what in Roberts' background gives people hope he will stand up for the little people? He must have missed the very same question asked yesterday.

Roberts gives a detailed answer, once again, and says his record is good on affirmative action, but has argued against "quotas". He has been active in programs that promote minorities.
