Will the Gang of 14's judicial filibuster compromise old?
Don't bet on it.
This is the Democrat party's worst nightmare. The moderate Justice O'Connor, rather than the conservative, retires. Justice O'Connor has personally been responsible for more 5-4 decisions on hot-button social issues than any sitting Justice (although Justice Kennedy is starting to giver her a run for her money). Examples -- Lawrence case (Sodomy); Kuhl Case (Eminent Domain); Webster (abortion), Ten Commandments, and the list goes on.
Now the democrats have a serious problem -- they have 7 party members who promised not to filibuster absent "extraordinary circumstances."
It is a near certainty that President Bush will nominate a candidate more conservative that Justice O'Connor. So, will the nomination of any pro-life nominee by definition constitute an "extraordinary circmstnace"? Clearly, the answer is "YES"!
Just wait -- the refrain from here on out is going to be that the President should appoint a moderate to replace a moderate to maintain "balance" on the Court. It's so predictable.
And the 7 Dems who agreed to the Filibuster compromise will be under unbelievable, tremendous pressure to break the deal if the President nominates a pro-life candidate. If the "Groups" (e.g., NARAL, Planned Parenthhod, PAW, ACLU, etc.) don't back you as a democrat, your political career is toast.
My prediction -- It is going to get ugly fast! For dems, too much of their liberal orthodoxy is tied up in the Court.
Rush is now saying that the president should IMMEDIATLEY nominate Jancie Rodgers Brown and watch the 'Rats squirm and try to filibuster and look like complete fools and liars.
Not really. The court will shift some; but not dramatically. O'Conner is not predictably wrong on constitutional issues. Just not predictably right. The big shift will come if and when Stevens, Kennedy, or Ginsburg retire. They are consistently wrong on the big issues and they are either old or have had serious health problems. That's the left's nightmare.
Theres giving your word to get something and then there is honoring that word...
and....Then there's the word of a politician...
Sounds like a plan to me.
Another interesting battle heating up....Between Kennedy's far left and McCain's Gang 0f 14. McCain was just on FOX and said there won't be a filibuster. He said, "the president will nominate a conservative, and will get an up or down vote". Sounded like a guarantee to me. And this was after the FOX anchor told him about Kennedy's inflammatory statement, almost a carbon copy of what some of the extreme far left fringe is saying about conservative picks.
Does FR have a betting parlor? I hear laughter.
He has a spine. It's what so called conservatives aim for when they stab him in the back.
That's good to hear. It sounds like the uproar after the gang of 7 did their number was heard loud and clear by McCain. Especially the defeat of DeWine's son. Conservatives are watching very closely and we are actually voting to punish defectors. McCain wants the nomination in 2008 and he cannot get it over concerted conservative opposition.
thank you for your # 89.

THIS is the whole POINT of US being able to WRITE!! and CALL UP these other traitors to let them know--we WILL be watching closely!!
Bump
That is not a requirement!!!!
The best way to pursue this type of strategy, would be to renominate Estrada and more like him to the lower courts, as well as bring Saad and others like him up to a vote ASAP.
It is time to go "all in" Texas Hold em style. Let the gang of 14 choke on "extreme circumstances." IMHO, this is the best way move forward.
I can see it now. In two minutes 32 seconds of round two, it's Ann Coulter over Ruth Bader Ginsburg by a knockout
That is a pretty good idea. Swamp 'em with well qualified conservative judges and make 'em look like the obstructionist fools they are.
Two more cents worth ...
One of the most persistent roadblocks to the confirmation of a conservative justice may not be a democrat filibuster. It may not even be the millions of dollars that are already being earmarked by organizations like moveon.org, NOW, People for the American Way/savethecourt.org, America Coming Together, etc. to convince the American public that we cannot tolerate the confirmation of a reactionary Supreme Court justice at this critical time in our history. Instead, it may be a 'republican' whom President Bush helped to retain his senate seat ... and his judiciary committee chairmanship.
Senate Judiciary Committee Chairman Arlen Specter is very ill, is serving his last term, is infamous for 'Borking' nominees who revere the original intent of the Constitution, and is equally infamous for breaking his promises.
Thanks to the unconstitutional runaway power of the judiciary, this appointment and confirmation will prove to be a (probably very bloody) watershed event in our history. And with Arlen Specter playing a leading role, I figure odds are about 50/50 on the outcome being one with which any of us will be happy, or one that will help tame the leftist judicial activism that is increasingly overshadowing the other two branches of government, increasingly relying on international law in its decision-making, and gradually implementing the blueprint for the United Socialist/Collectivist States of America (a la Kelo vs. New London).
