Rush is now saying that the president should IMMEDIATLEY nominate Jancie Rodgers Brown and watch the 'Rats squirm and try to filibuster and look like complete fools and liars.

Not really. The court will shift some; but not dramatically. O'Conner is not predictably wrong on constitutional issues. Just not predictably right. The big shift will come if and when Stevens, Kennedy, or Ginsburg retire. They are consistently wrong on the big issues and they are either old or have had serious health problems. That's the left's nightmare.

I believe both Lawrence Tribe and Fred Barnes both meant this is a tsunami/nightmare for the democrats because of the timing. We're at war, people won't want obstructionism in something this historical, this important, and after the so recent fight over judges, the democrats won't get away with more of the same.

Another interesting battle heating up....Between Kennedy's far left and McCain's Gang 0f 14. McCain was just on FOX and said there won't be a filibuster. He said, "the president will nominate a conservative, and will get an up or down vote". Sounded like a guarantee to me. And this was after the FOX anchor told him about Kennedy's inflammatory statement, almost a carbon copy of what some of the extreme far left fringe is saying about conservative picks.

It is a near certainty that President Bush will nominate a candidate more conservative that Justice O'Connor.

That's good to hear. It sounds like the uproar after the gang of 7 did their number was heard loud and clear by McCain. Especially the defeat of DeWine's son. Conservatives are watching very closely and we are actually voting to punish defectors. McCain wants the nomination in 2008 and he cannot get it over concerted conservative opposition.

You know, there is a strategy here to be used. Put out the name of someone whom the 'Rats positively HATE and would go into convulsions over and after they have gone nuts all over the place, withdraw that name and substitute a good solid conservative with a less recognizeable name, making it harder to bork them.

The best way to pursue this type of strategy, would be to renominate Estrada and more like him to the lower courts, as well as bring Saad and others like him up to a vote ASAP.

It is time to go "all in" Texas Hold em style. Let the gang of 14 choke on "extreme circumstances." IMHO, this is the best way move forward.

Excellent observations.

Two more cents worth ...

One of the most persistent roadblocks to the confirmation of a conservative justice may not be a democrat filibuster. It may not even be the millions of dollars that are already being earmarked by organizations like moveon.org, NOW, People for the American Way/savethecourt.org, America Coming Together, etc. to convince the American public that we cannot tolerate the confirmation of a ‘reactionary’ Supreme Court justice at this critical time in our history. Instead, it may be a 'republican' whom President Bush helped to retain his senate seat ... and his judiciary committee chairmanship.

Senate Judiciary Committee Chairman Arlen Specter is very ill, is serving his last term, is infamous for 'Borking' nominees who revere the original intent of the Constitution, and is equally infamous for breaking his promises.

Thanks to the unconstitutional runaway power of the judiciary, this appointment and confirmation will prove to be a (probably very bloody) watershed event in our history. And with Arlen Specter playing a leading role, I figure odds are about 50/50 on the outcome being one with which any of us will be happy, or one that will help tame the leftist judicial activism that is increasingly overshadowing the other two branches of government, increasingly relying on international law in its decision-making, and gradually implementing the blueprint for the United Socialist/Collectivist States of America (a la Kelo vs. New London).
