By 2 p.m. Saturday, four San Jose police cars had converged in the parking lot of perhaps the world's most famous Wendy's. But the officers inside the Monterey Road restaurant weren't serving a search warrant in connection with fingers or chili or anything else. They were being served.
Lunch.
It was what passes as a normal Saturday these days at that Wendy's, which has seen business drop off dramatically since the night of March 22, when customer Anna Ayala said she found a human finger in her chili.
As tests continue to determine the finger's origin, the 39-year-old Ayala has been under increased scrutiny; police searched her Las Vegas home Wednesday, and The Chronicle reported Saturday that she has a history of legal battles, including a 2003 claim against a Las Vegas restaurant alleging that tainted food sickened her daughter.
San Jose police are investigating. Ayala has said she bit into the finger, which was in her bowl of chili.
Wendy's officials have said they have checked their supply chain and are confident it didn't come from a worker or supplier. And the Santa Clara County medical examiner is waiting for the state to complete DNA tests on the 1 1/2- inch digit.
At her Las Vegas home, Ayala did not want to talk with reporters Saturday morning, so she sent out family friend Ken Bono, 24, as a spokesman. Bono scoffed at the reports that Ayala was litigious.
"It doesn't prove anything," he said. "My mom has 10 lawsuits. A lot of people have lawsuits. Why would she sue for money? She has plenty of money."

I hope they nail this broad. The only jury I've sat on to date was a case just like this, where the woman sued everyone...her bank, her neighbors, even her own children. We threw the book at her.
I don't have a history of 10 lawsuits. I don't even have a single one, and I don't know anyone else who has.
If this nutcase "has plenty of money", I would be interesting in knowing how she came by it. We have been told nothing about what she does for a living.
What business is it of mine? Every nutcase who causes businesses to spend millions defending themselves or paying people to go away, even if innocent, simply raise prices for everything for the rest of us.
It might no longer be the case, but at one point, 60% of the price of a ladder was liability insurance...
I guess she is out of fingers then.....
I'll still go to Wendy's, some stupid slip-and-fall artist isn't going to stop me. I'm curious as to where she got the finger (maybe a friend in the mortuary business?).

They will not recover what they lost, but they might just
do it anyway, and then offer to settle, if the perp appears
in national Wendy's ads confessing to the scam.
This women, if this pans out as fraud like it looks, needs to do REAL JAIL TIME. Apparently she has a history of lawsuits and, more creepy, had an Aunt who recently passed--perhaps the source of the finger.
Not for long.
640 KFI Los Angeles reported she had an Aunt recently pass away.
Somehow I think it is in the best interest for Wendy's to do what they have to do legally, but to not talk about it in news, every time I think of a finger in chili it repulses me even though I know it was false, it is so repulsive that chili is the last thing I would get from Wendy's. I did go to Wendy's today for lunch though
I hope they disbar her shyster lawyer, too.

I heard about a case where man is in prison now for falsely stating he found fried mouse (?) in chicken fingers at McDonald's. It seems if I remember correctly they compared the grease and since it was different Bingo

I have to agree. I too, have never had a single lawsuit, not do I know anyone who ever has either. And since I've never personlly known anyone who has had a lawsuit, and they have never mentioned anyone they know having a lawsuit either, I can assume nobody they know has ever had a lawsuit. That's a lot of people.
I suspected this from the start. Obtaining a finger isn't easy, and what would be the motivation for a restaurant worker or someone working on the chili supply end to do this? Going to such lengths to be spiteful or gross when there's nothing to gain except maybe job loss and legal hassles doesn't make sense.
That's where'd you'd find out if the legal community was serious about restoring credibility of the courts.
Funny, though, I don't think they will.
