TERRI SCHIAVO DAILY MARCH 2005 PART 6- NO FOOD OR WATER IN THE 6TH-7TH DAYS - GOOD FRIDAY
various | 3-24-05

Posted on 03/25/2005 12:17:45 AM PST by STARWISE

Judge George Greer ruled that the State of Florida has no right to take custody of Terri Schiavo, which ruling came hours after an appeal by Terri's parents to re-insert the feeding tube was refused by the U.S. Supreme Court.

Meanwhile, another hearing was scheduled tonight before US District Judge James D. Whittemore .. the same judge who previously heard and denied the request subsequent to the 'de novo' intention of the law past last weekend by the Congress and signed by President Bush, in an effort to confirm that no stone was left unturned before Terri would endure legally sanctioned dehydration until death.

"I've got to wonder how much of Jeb's words are true ignorance of the laws of his own state and how much is CYA BS...."

A person whose profession is words and use of words, combed through the law and tearfully said, "He's right, there doesn't seem to be anything he can do".

I have confidence that legal experts are still looking for a way. The what does 'IS' mean that might be lurking in there somewhere.

Those publicly suggesting the Governor can do something have their own political posturing to do.....and nothing to lose.

The solution is not anarchy. We must see that the laws are changed!

Because hino banned her parents for several hours while he and his minions went in to her room. I think it was Floriduh Voter (or one of the other good folks there) who said they came out of the hospice and started harrassing the pro-Terri people. One even was so ugly to FV that a policeman was called over.

Terri said "Where there's life, there's hope," so let's not give up.

I called President Bush's comment line, 1-202-456-1111 and asked him to use his executive powers to save Terri.

There's more we can do!!! ESPECIALLY PRAY!!! But God works through his people, so let's take action, too.

Here's an e-mail I received today from rightmarch.com, a great group. Another number that RightMarch did not include is the Governor's Legislative Affairs Office: 1-850-488-5000 (might be easier to get through). I told them if children and grannies are getting arrested, Governor Bush should not be afraid, either.

So here's the info:

ALERT: Time is running out for Terri Schiavo. She's been
starving to death for seven days now. An expert neurologist
from the Mayo Clinic has testified that she is NOT in a
"persistent vegetative state," but is very aware of what
is going on around her. That means that in her present
state, she is in a great deal of pain and suffering from
starving to death -- she just can't communicate that fact
to those around her. Contrary to those that try to paint
a picture of a "gentle process," death by dehydration is a
cruel, inhumane and often agonizing death.

We MUST stop this inhumanity NOW.

Governor Jeb Bush is Terri's last hope. But it's not looking
very likely that he'll act on the authority he has... unless
he hears from YOU and ME in a powerful way, RIGHT NOW.

We had a meeting on Wednesday between folks from RightMarch
(William Greene and our attorney, Larry Klayman) and Governor
Bush's chief counsel (his top lawyer on staff). We presented
information on why the Governor has the authority RIGHT NOW
under Florida Law and the state constitution to take Terri
into protective custody NOW, and save her life.

Gov. Bush failed to take action.

We had a meeting on Thursday between our folks (this time,
Larry Klayman AND Ambassador Alan Keyes) and Gov. Bush's
Chief of Staff. Dr. Keyes eloquently explained to him why
the Governor has the authority RIGHT NOW under Florida Law
and the state constitution to take Terri into protective
custody NOW, and save her life.

Gov. Bush failed to take action.

In fact, at one point, we received definitive word that the
Florida Department of Children and Families (DCF) was on
their way to the hospice where Terri is being held, to take
her in and re-insert her feeding tube. Then, the little
dictatorial tyrant, Judge Greer, gave an order for them to
NOT take her. They could have -- and should have -- ignored
this unconstitutional and illegal order... but Gov. Bush
told them to stop.

Gov. Bush failed to take action.

This is OUTRAGEOUS. Judge Greer has shown more courage in
trying to KILL Terri Schiavo than Gov. Bush has shown in
trying to save her. But instead of facing Judge Greer down
like he should have... Bush blinked.

This is THE pivotal moment in Gov. Bush's political career.
He MUST be a hero for Terri Schiavo. He needs to step up
to the plate NOW, and exercise his constitutional and legal
authority NOW, before Terri dies. But he doesn't seem to
be willing to take that chance and do it... so we need to
help encourage him.

So once more, we need YOUR help.

We need EVERYONE READING THIS MESSAGE to call Governor
Jeb Bush RIGHT AWAY, and ask him to do one simple thing:

"PLEASE EXERCISE YOUR CONSTITUTIONAL AUTHORITY, AND
TAKE TERRI SCHIAVO INTO PROTECTIVE CUSTODY RIGHT AWAY."

That's all we're asking you to do. Just call Gov. Bush
NOW and beg him to save Terri's life, using the power he
already has.

TAKE ACTION: PLEASE call Governor Jeb Bush's office NOW
at 850-488-4441 (or fax him at 850-487-0801), asking him
to exercise the executive powers he ALREADY HAS, and take
custody of Terri Schiavo to save her from being starved
to death. You can also e-mail him at jeb@myflorida.com .

We've been here lobbying the Governor all week long. We've
had daily prayer vigils in his office, and nightly vigils
outside of his mansion at 700 North Adams. Hundreds of
people have been outside of Terri's hospice in Pinellas
Park, and we have chartered buses to bring many of them
here to Tallahassee to plead with Gov. Bush to use the
powers he has NOW to save Terri's life NOW.

Even Terri's parents, the Schindlers, will be on ALL THREE
major network morning shows today, thanks to our efforts,
pleading with Gov. Bush to act quickly. And we'll be here
ALL DAY on Good Friday to ask Gov. Bush to intervene to
save the life of Terri Schiavo. The governor has it within
his power to rescue Terri, and her life is in the governor's
hand.

You can click below to read -- AND USE -- the five legal
briefs that explain to Gov. Jeb Bush that he has the legal
authority to save Terri Schiavo:

Call Gov. Bush NOW and ask him to USE his legal powers to save
Terri's life. For the sake of Terri's life, we CANNOT afford
to wait while the courts bicker over jurisdiction -- and we
CANNOT let little two-bit judges order the Executive branch
to not do their duty.

I disagree with your statement. She loves and she is loved (not to mention, breathes, smiles, laughs, and her bodily functions do work, whether it's in a diaper or not, is not the point.) That's enough reason for life. The fact of the matter is every rule that would govern this has been bent or snapped completely in two. Prior to being starved to death, she was no more in the process of dying then anyone else who has been born is preparing for the ultimate time of dying. I'm so glad that we didn't listen to the doctor's nurses, and therapists who told us just to put my semi-comatose brother in a warehouse to wither away. He's a vital active member of our family now. The point is, she has family that will care for her. (We can ignore the points that Michael Shiavo received an awful lot of money for her lifelong care that he has chosen to spend on another family)

It feels a little hopeless right now in my eyes, but we must not turn away in defeat, keep praying, keep writing the govenor, keep on keeping on. If you're close enough to go there, go there and show support.

Yes, that was a horrid account. The Schiavo family and friends seem to be gloating about all this. After Terri passes (which seems to be certain now) watch the television closely. I think the gloating will be out in the open for all to see. This is what we have come to now.

Funny you should ask, I just completed my Health Care Directive:

HEALTH CARE DIRECTIVE

I direct my health care provider(s) and health care agent to make health care decisions consistent with my general desire for the use of medical treatment that would preserve my life, as well as for the use of medical treatment that can cure, improve, or reduce or prevent deterioration in, any physical or mental condition.

Food and water are not medical treatment, but basic necessities. I direct my health care provider(s) and health care agent to provide me with food and fluids orally, intravenously, by tube, or by other means to the full extent necessary both to preserve my life and to assure me the optimal health possible.

I direct that medication to alleviate my pain be provided, as long as the medication is not used in order to cause my death. I direct that the following be provided: the administration of medication, cardiopulmonary resuscitation (CPR); and the performance of all other medical procedures, techniques, and technologies, including surgery, -- all to the full extent necessary to correct, reverse, or alleviate life-threatening or health-impairing conditions, or complications arising from those conditions.

I also direct that I be provided basic nursing care and procedures to provide comfort care.

The instructions in this document are intended to be followed even if suicide is alleged to be attempted at some point after it is signed.

I request and direct that medical treatment and care be provided to me to preserve my life without discrimination based on my age or physical or mental disability or the "quality" of my life. I reject any action or omission that is intended to cause or hasten my death.

I direct my health care provider(s) and health care agent to follow the above policy, even if I am judged to be incompetent. During the time I am incompetent, my agent, as named below, is authorized to make medical decisions on my behalf, consistent with the above policy, after consultation with my health care provider(s), utilizing the most current diagnoses and/or prognosis of my medical condition, in the following situations with the written special conditions.

WHEN MY DEATH IS IMMINENT
1. If I have an incurable terminal illness or injury, and I will die imminently--meaning that a reasonably prudent physician, knowledgeable about the case and the treatment possibilities with respect to the medical conditions involved, would judge that I will live only a week or less even if lifesaving treatment or care is provided to me--the following may be withheld or withdrawn:

YOU MAY NOT WITHDRAW ANY TREATMENT, FOR ANY REASON

WHEN I AM TERMINALLY ILL
2. Final Stage of Terminal Condition. If I have an incurable terminal illness or injury and even though death is not imminent I am in the final stage of that terminal condition--meaning that a reasonably prudent physician, knowledgeable about the case and the treatment possibilities with respect to the medical conditions involved, would judge that I will live only three months or less, even if lifesaving treatment or care is provided to me--the following may be withheld or withdrawn:

YOU MAY NOT WITHDRAW ANY TREATMENT, FOR ANY REASON

I understand that I have the right to revoke the appointment of the persons named below to act on my behalf at any time by communicating that decision to the agent or my health care provider.

I hereby revoke all prior designations of agent under any other Durable Power of Attorney for Health Care Decision Making I have made in the past.

If the authority granted in this document conflicts with authority I have granted in a Health Care Declaration/Living Will or designation of Proxy for intrusive mental health treatment, the person designated most recently shall control the outcome of that conflict.

If any part of this document is held to be unenforceable under law, I direct that all of the other provisions of the document shall remain in force and effect.

I designate my Health Care Agent to be: XXXX
If he/she is unable, I designate: XXXX

God will take me in his own time.

NOTE: It's been very expensive for us to engage in this

If YOU were in Terri's condition (howsoever you choose to describe it), would you prefer to have your stomach pumped some more with slurry and wear diapers for another 10 or 20 or 30 years OR go home to Heaven?

I would rather live with a couple of doting parents, who would take me outside in the fresh air, where I could feel the sunshine and the cool breeze, and then return homme to a couple of friendly kitty cats, listen to some music, and maybe catch a TV news report that Michael R. Schiavo had been sent to prison for life for attempted murder, torture, embezzlement, and who knows what else, and consequently wasn't going to be bothering me anymore.
