Michael Schiavo Files Request With the SCOTUS, USSC Refuses to Take Schiavo Case

Michael Schiavo has filed a petition with the Supreme Court asking them to stay out of the case.

Yes, and most often by dying. After Terri's death, it will be time to address these issues. They're complex ones, and cannot be fully addressed in a day, a week, or even more.

Terri's death will bring this entire issue to the forefront. Do we want people to be able to withdraw life support at all? Apparently we do. Is a verbal statement to a spouse sufficient? Apparently it is.

All of these questions can be addressed, but not today.

me too.....I am just so angry about this ......soon, I will go and bake some Easter cookies, or boil the eggs for decorating....some activity that helps me remember the Easter season, something that is hard to find with the bad news about Terri.....

Your argument to let her die is specious. Of course she is better off in Heaven. We all are. But even given that, God commanded us not to murder. Not even ourselves. No one has the right to take an innocent life; not even Terri can authorize someone to kill her. That's why Kevorkian was stopped (thank God).

Terri has never gotten a fair trial. All these judges are covering for each other because they covet their unbridled power.

Someday you or I could be a useless eater like Terri. God help us if the only advocate we have is a monster like M. Schiavo or Felos who then tells everyone else what we "wanted."

Florida Stat. Ann. 798.01 - Living in open adultery:

"Whoever lives in an open state of adultery shall be punished by imprisonment in the state prison not exceeding two years, or in the county jail not exceeding one year, or by fine not exceeding five hundred dollars. Where either of the parties living in an open state of adultery is married, both parties so living shall be deemed to be guilty of the offense provided for in this section."

Adultery is a crime in Florida. Will someone with the right connections please use this as a point of attack on Michael Schiavo's guardianship? Anybody?

"Saying something to the that effect" to each other is not necessarily legal and binding. Get it in writing. Just in case.

Why would you have an opinion in a matter between my wife and I?

I don't have an opinion on a matter between you and your wife and I won't as long as her desires are clearly written and/or the circumstances surrounding your desires are not suspect.

That's a fairly normal progression for anoxic brain failure. The tissue dies from lack of oxygen, but would still show up on the CT scan as normal. A couple of days later, it begins to break down and be replaced with cerebro-spinal fluid.

Don't make too much of this. It's a normal result.

A number of the SCOTUS are currently seriously ill or have been recently.They must be updating their Living Wills as I type.

I think chief justice Rehnquist is being kept alive artificially with some type of a breathing device. It should be pulled... What kind of quality of life can he have under those gold-ribboned black robes? What happened to "justice and liberty for all"? Oh, I forgot... those nine are SUPREME. They must be the supreme being(s) so often referred to in our country's founding documents.

I am astounded when I hear people say the feeding of another human being interrupts G_d's Will. This is like the Spanish Inquisition claiming that if the accused is innocent, they will be saved by G_d's immediate intervention.

YOu worry too damn much. No new judicial precendents have been created by this case. Peolpe have been free to refuse medical care for years. All of the Federal courts just refused to give Terri a temporary stay to allow the feeding tube to reinserted. The Federal law passed Sunday night was clearly unconstitutional and would have been struck down. No new legal prescendents have been set. This whole thing would have been moot if you could have gotten three or four more votes in the Florida legislature. Suggest you go back there later and get the law rewritten and insist that your state legislature do the same.

MineralMan: It depends where you are. In most states, the next of kin can cancel life support after consultation with the physician. It happens every day. A young person is in a car accident and is brain dead. Parents have to make a decision about maintaining their body in a lifelike state. Most decide to let the son or daughter die and remove the life support. Same with parents. Every day, in hospitals all over this country, children make decisions about life support for their parents, whether there's a living will or not. Surely you know this.

Cboldt: The subject isn't brain dead people. It is PVS (and as you know, that diagnosis is contested .. but even if it was not), and the law is different then. As far as I know, the law looks for an Advance Directive from the living patient. THis is different from looking for the advanced directive of a brain dead patient. Cboldt: So, do you have a cite for the proposition that somebody other than the PATIENT has a legal right to decide, when the PATIENT is in PVS? I understand that state laws may differ on that point. State law in Florida give the power (to decide) to the PATIENT and NOBODY ELSE

Thought you might find that useful, because we are not looking for a general proposition about "removing life support" for an otherwise terminal patient. We are talking about provoking the demise of a patient based on our perception of their mental capaicty and our belief about whether they would choose to commit suicide because they are in that diminished capacity.

I have not seen one bit of evidence that he is going to get millions of dollars. In fact, the one thing I did see about money showed that there was almost no money left in the trust.
