Generally, appeals courts do not consider new evidence. They can, if they wish, order the lower court to retry the case, based on new evidence, but that's apparently not going to happen here.
It's unlikely, in my opinion, that the 11th Circuit will overrule the judge from yesterday. That's a pretty rare event, as you may know.
They can, if they wish, issue an order that the feeding tube be restored, but I consider that unlikely as well.

No, I will NEVER "come to grips" with the gov't of my country murdering people by judicial decree any more than I ever came to terms with what went on in Waco, or with Randy Weaver's family, or with Elian Gonzales. This is worse because this woman did NOTHING. She's innocent of any crime, and yet my country affords her less rights than a mass murderer, and a huge number of people (like you) want to look the other way and pretend that it's fine that some judge in a FL cesspool can murder anybody he chooses to cover up the crap!

The district court was a long shot to begin with. Succeeding in Atlanta would be more than a hole in one. It would be like hitting a hole in one into the eighteenth hole at Bay Hill, while playing golf at Augusta.
Also, it would have been better if the legislation had removed her from FL, putting the matter in say the Southern District of Alabama. Of course, a clintoid there may have ruled the same way, probably would have. DeLay just struck out but not for lack of trying.
I get the impression that the courts are dithering on this case in order to exhaust time so that if her death comes prematurely (God forbid) or she succumbs to an even more debilitated state (whereby she will need external help to breath which would make the courts decision easier!) then the judiciary will not have to rule on this issue. Thus not creating a precedent wherby the legislative supercedes the authority of the courts of what was assumed to be a judiciary perview.
Terri is currently in the process of being starved to death. No... no one's out to get her. But you can't argue with the fact that she is about to die at the hands of 'no one'.

That is why I'm making a living will. My boyfriend already has instructions on what to do when he passes away. He has a huge book collection and told me he wanted to donate them to the library. LOL I was sooo mad I told him "NO - I'm going to have a big book burning fire in the middle of my street and dance around naked!" LOL scared the heck out of him. But of course he knows underneath how I feel about a human being's last wish that I would follow it to the letter but I really loved seeing him squirm!

Seems to me there's grounds for Gov. Bush to do this, in light of "Judge" Greer's refusal to allow DCF to even begin and investigation of charges of abuse and neglect by Michael Schiavo.
If you or I were suspected of neglecting a child or a disabled member of our family, you know DCF would be on our doorsteps PRONTO and taking custody away from us, if only temporarily, until the charges were fully investigated!
Even if Michael Schiavo were not implicated in causing Terri's condition in the first place, he is SURELY guilty of abuse and neglect in the way he's refused her just the common decencies of
- routine medical and dental care.
- therapy (if only to keep her hand muscles from contracting so that her fingernails don't dig into her palms)
- and just letting her be taken outside into the sunshine and fresh air
On Michael's orders, Terri has been locked in a virtual dungeon for YEARS -- she isn't even permitted to have music, or television, or radio played in her room. This in itself violates all standards of decent nursing care that I have ever heard of!
I have been wondering where are all the usual black spokesman such as JJ and Rev. Al on this issue?

I believe that if Terry was a black woman that there would be outcries from the black community claiming racism of the white judicial system and state ordered executionn of another poor black person.
Has he heard Kate Adamson's story? The doctors claimed it would be painless. She describes the pain she went through while they were starving and dehydrating her to death.

Just one more Democrat to add to the "foot dragging" that is obviously the plan to run out the clock. This sob wasted 24 hrs. of Terri's time, better than Wexler and his 2 cohorts in congress did. They only managed to eat up 12 hrs.
