Generally, appeals courts do not consider new evidence. They can, if they wish, order the lower court to retry the case, based on new evidence, but that's apparently not going to happen here.

It's unlikely, in my opinion, that the 11th Circuit will overrule the judge from yesterday. That's a pretty rare event, as you may know.

They can, if they wish, issue an order that the feeding tube be restored, but I consider that unlikely as well.
