NEW BEDFORD, Mass. -- A man who shot and killed another man on his property has been indicted for second-degree murder, according to prosecutors. The grand jury indicted Charles D. Chieppa, 56, for the July 17 shooting of 26-year-old Frank Pereira Jr. with a rifle.The fatal shots were fired near Chieppa's property just before dawn. By sunrise, motorists drove past Mr. Pereira's body, honking their horns and shouting in support of the shooting, the Standard-Times of New Bedford reported.
Chieppa, a Vietnam War combat veteran, lived in his parent's old home and largely kept to himself, neighbors said.
The home was next to Alfie's bar, which is known for drug dealing and prostitution. Pereira had snatched a purse from an Alfie's patron just hours before he was shot, police said.
Police had initially said the shooting happened when Chieppa confronted a burglar breaking into his home around 4 a.m. A day later, detectives acknowledged that they were investigating whether Pereira had actually entered the house before Chieppa opened fire.

"My son didn't deserve to die the way he did, even if he was trying to break in," said Evelina Salgueiro, the victim's mother. "You don't shoot someone in the back like that. He was shot in the street."

From the comments I see here on Texas law, this would be no-billed there. Perp was breaking into cars in the homeowner's driveway, took a bullet for his efforts.

That's right. He deserved to die a much worse death.
Actually it seems like the street cops wanted to keep it that way. Not sure why the detectives pursued it further. The area is pretty nasty. New Bedford has become a run down neighborhood. It's gotten worse since the feds closed down most of the fishing fleet out of there. At one time (1800s) New Bedford was a class address to have. It was also the center of the anti-slavery movement.

This guy's a pillar of society according to his mother. (sarcasm) This is a case of applied socialism, redistribution of oxygen from someone who obviously had too much and was wasting it to those who really need it. (more sarcasm)

Humor: The old rule was that the perp has to be IN THE HOME to support a "self-defense" defense for the homeowner. As a youngster I used to hear the adults say: if you shoot him on the back steps be sure to drag him into the kitchen before you call the cops.

Once upon a time in this nation, we believed that if someone stuck their finger in an electric outlet they deserved to get shocked for being dumb enough to stick their finger in the outlet. We also believed that the consequences of their action would serve as a lesson to them and to others.
Today though, our nanny state, which neither believes that anyone should ever have to suffer the consequences of their actions nor should there be any lessons, would like to charge the electric outlet for causing harm to the fool who stuck his finger in it. But for obvious reasons, they can't bring charges against it, so they bring charges against the electric company and the makers of electric outlets. All of this just goes to show how disconnected from reality America has become.
In many states, a private citizen is allowed to use deadly force in the apprehension of a fleeing felon. The cops can't always do so.
Yes...in Texas...especially if this happened at night....there are codified defences to prosecution. This does not mean one will not take the ride...but a no-bill is likely. Even valdalism at night can get the perp....plugged...
Hmmmm.....so he was caught commiting this crime...wanna bet he has gotten away with many other crimes?
Someone refresh my memory was it Massachusetts where a prominent politician suggested that if you discover a burglar in your home you should flee your home and let the police handle it?
This is horrible. If this kind of activity keeps up, we could be facing a crime shortage.

Sadly...many of these vermin have resorted to robbing little old ladies in their driveways....
