From the comments I see here on Texas law, this would be no-billed there. Perp was breaking into cars in the homeowner's driveway, took a bullet for his efforts.

Actually it seems like the street cops wanted to keep it that way. Not sure why the detectives pursued it further. The area is pretty nasty. New Bedford has become a run down neighborhood. It's gotten worse since the feds closed down most of the fishing fleet out of there. At one time (1800s) New Bedford was a class address to have. It was also the center of the anti-slavery movement.

Yes...in Texas...especially if this happened at night....there are codified defences to prosecution. This does not mean one will not take the ride...but a no-bill is likely. Even valdalism at night can get the perp....plugged...

Unfortunately- the way the laws are written- you cannot shoot someone to protect your property- only yourself! He will be off due to no priors etc but I am sure the media will paint this dead kid as a saint that went bad due to poverty and uncaring parents and teachers- BWAAAHHH

That's my impression of Texas law too. I lived there for decades.

There was an auto repo person killed by shotgun while trying to tow a car away. Apparently the repo person didn't want the police to accompany him as the city of Houston gets 25.00 for their time when doing this.

Looked like theft to the owner, who had some trouble with kids trying to steal his car earlier in the week.

That was in Dallas, the kids were trying to steal his expensive wheels. An earlier set had already been stolen. He fired at the kids, killing one in their vehicle. On several grounds he was within the law. Theft during the night, stoping a felonly crime in progress would be two of them. He shouldn't have even been charged. Maybe since he used an SKS on the punks?
