TERRI SCHINDLER SCHIAVO JANUARY 2005 Dailies: News Digest, Restating the Obvious & Thank Yous...
Free Republic & Various Sources ^ | December 30, 2004 | Floriduh Voter

Posted on 12/29/2004 7:16:22 AM PST by floriduh voter

The Terri Schindler Schiavo Daily Threads are created month to month as we watch local and national news regarding Terri and her family.

Since Terri's supporters are in every time zone, you may see something FIRST. Please share news with us that you don't see here already. Now, why would you want to do that? Terri's Daily Thread for September/October of 2004 was viewed over 15,000 times. Terri's November Daily Thread was viewed over 6,000 times. December's thread is over 3,000 views.

More and more good folks are finding out about Terri and that judicial tyranny would take her life, but for lots and lots of prayer and non-stop lobbying of relatives, friends, clergy, our leaders, the media, a passerby, a cashier - ANYONE who you feel comfortable chatting with.

Folks always want to know how can this be in America or on earth for that matter? Unfortunately, this is really happening to an innocent woman who just celebrated her 41st birthday. She's not the only one but she's the one with devoted parents and siblings who knows what's in Terri's heart. Terri has a strong will to live. That's apparent. It's been 14 years.

Besides, feeding tubes have been around practically since the Civil War. They are not high tech devices. Terri is "not hooked up to machines". Her feeding tube is the diameter of a piece of spaghetti.

Talkin' about Terri is the best way to lobby for her. It is a salespitch to save her life and subsequently, many lives. If you've never sold anything in your life, START NOW. START WITH TERRI.

See Terri's flash movies if you need more information. You can see for yourself that's she's interactive and follows the doctor's instructions.

NOTE: Terri's December Dailies are noted as a source above. There are lots of important links at the very top of that thread. If you missed Terri's Celebration of Life, you can click on it from there.

A more appropriate statute can be found at http://www.flsenate.gov/statutes/index.cfm?App_mode=Display_Statute&URL=Ch0765/ch0765.htm

Title XLIV CHAPTER 765 provides definitions for PVS, advance directive, informed consent, and some other pertinent terms. It provides for the withholding or removal of certain treatments in the event the treatment does more harm than good. It specifically forbids the form of euthanasia that Terri has been ordered to succumb to. Euthanasia is forbidden, even at the request of the patient. The statutes provide clear requirements that must be satisfied in determining a patient's wishes. These requirements were not satisfied by the evidence, contrary to any statements you may have heard after the fact. I hate to state the obvious, but the only evidence is the evidence. Any characterization or mischaracterization of the evidence by judges, lawyers or others is not evidence.

Terri's feeding tube is causing no harm, and even her estranged husband doesn't claim that it does. To remove it, would by legal definition, be euthanasia, which this statute forbids.

The fact that no one is under arrest for the crimes being committed is not an indication of anything other than corruption. If you're looking for proof of Terri's cognitive abilities, and whether they rise to inclusion in the statute, look at the reports of every doctor who has examined her. Even the doctors who were paid to promote their liberal definitions of PVS testified to her level of awareness and ability being higher than the legal definition for PVS.

PLEASE SEE POST 370 and email the Advocacy Center. It's an important email to send. You don't have to write much. "Free Terri, she's alert and aware of her surroundings".

I'm going to email them tomorrow. FV

LIFE AND DEATH TUG OF WAR
New attorneys maneuver to save Terri Schiavo
File motion asserting order to remove feeding tube was in error

© 2005 WorldNetDaily.com

The parents of Terri Schiavo asked a court yesterday to void an order to remove the brain-damaged Florida woman's feeding tube, arguing she has been denied due process of law.

The new attorneys for Robert and Mary Schindler say that in their review of the boxes of court filings from the decade-long case, they can't find a single instance in which "Terri was afforded the right of every American to have a lawyer who would represent her own interests."

"Her parents have an attorney. Her husband has an attorney; but Terri has never had an attorney who could attempt to communicate with her and could represent her interests while her parents and husband battle over whether she should live or die," said attorney David Gibbs III in a statement.

Schiavo has lived in a Pinellas County hospice facility for nearly five years while her husband and guardian Michael Schiavo awaits permission from the county court to remove her feeding tube, which would result in death by starvation and dehydration.

The new motion argues that the courts have applied the wrong law to statements Terri allegedly made in the mid-1980s that she would not want to live on life support.

Her parents insist Terri never made such statements, but Gibbs says, "even if she did, in the 1980s under Florida law, assisted feeding was not considered to be life support."

The Schindlers' attorneys also argue the courts in this case have violated the constitutional separation of powers.

By acting as judge, law-maker, and proxy-guardian, the court is intruding into the roles of the legislative and executive branches of the Florida government, the motion says. In so doing, it has shed the neutral and objective judicial function to which Schiavo is entitled and which is required by law.

As WorldNetDaily reported, despite the widely believed claims of her husband, Terri Schiavo is purposefully interactive, curious and expressive with her parents, according to Gibbs and attorney Barbara Weller, who visited Terri Christmas Eve.

Weller concluded Schiavo was so alert that she "should have been gathered around the Christmas dinner table enjoying the holiday with her family."

Not knowing what to expect prior to the visit, Weller said in a narrative posted on the family website she "prepared for the possibility that the Schindlers love their daughter and sister so much that they might imagine behaviors by Terri that aren't actually evident to others."

But she was "very surprised" to find that, "From the moment we entered the room, my impression was that Terri was very purposeful and interactive and she seemed very curious about the presence of obvious strangers in her room."

As WorldNetDaily has reported, Terri collapsed in 1990 in the couple's St. Petersburg apartment. For reasons never satisfactorily explained, oxygen to her brain was cut off for several minutes, leaving her unable to talk and dependent on a feeding tube for food and hydration at the age of 26.

In a 2000 trial, Michael Schiavo persuaded Florida probate Judge George Greer that Terri is in a "persistent vegetative state," which in the absence of a written directive, allowed Michael Schiavo to request removal of her feeding tube.

In November, however, Greer ruled the tube cannot be removed until the Schindlers have exhausted all avenues in their quest for a new trial to determine whether or not their daughter would want to be starved to death.

Michael Schiavo insists he simply is carrying out his wife's wishes, but Terri's parents contend Terri is alert, has a strong will to live and could be significantly rehabilitated with aggressive therapy. More than a dozen physicians, therapists and speech pathologists have stepped forward to state agreement with the Schindlers.

The parents also assert Michael Schiavo's interests are conflicted since he has lived with another woman for at least nine years with whom he has had two children.

Court documents and other information are posted on the Schindler family website.

Links to all "Terri briefs" regarding the governor's defense of Terri's Law are on the Florida Supreme Court website, public information.

I think we should ALL contact the Advocacy Center and request an update on their investigation.
Here are the e-mail addresses fo the Board Members as of September.
Even MORE important that writing to the Advocacy Center, IMHO, is that we write to the Board Members. Management has to know they have the Board of Directors to answer to.
They took a responsibility as a Board Member, let's see them live up to the responsibility they took.

This is great work you've done, and I completely appreciate it! In the future, if you could ping myself or floriduh voter, rather than to "all", you may get more attention to your post. Sometimes on these long threads it's hard to find out where I left off reading. I'm glad I backtracked some, because your post was well worth the effort you put into it. I'll ping others to it now.

Terri ping to post 370! This is a long post, but I think it is very worthwhile to check it out. I appreciate the effort that our fellow Freeper in France has undertaken on Terri's behalf. It sure would be nice to know how that investigation is going, and if there is anything that we as a group of advocates for Terri can do to move it along.

If anyone would like to be added to or removed from my Terri ping list, please let me know here or by FReepmail.

The below post is continuing from post 370 which is really IMPORTANT that you read.

***POST 370 is IMPORTANT****

Team Freepers, IMHO things are not looking all that great in the courts for Terri right now, this open investigation is the only outside investigation that I am aware of.

Almost allt he Board Memebers work in higher education, not all but most. They are still on winter break and this would be a good time to write to them, most likely they are checking their work e-mail from home. They are off right now and have the time to do some leg work, but we really REALLY need YOU to take jsut a few minutes to send them an e-mail.

How can there be any public confidence in the judiciary

George W. Greer would say that his 65 percent showing on Aug. 31, 2004, is proof of public support for HIM.

I'm going to email the Board Members at the Advocacy Center and I think I'll include exact quotes from Alberto Gonzalez.

We have such great material from USAG Nominee Gonzalez's grilling yesterday. He said that the Bush Administration does not condone torture and abuse of anyone. They better back up their words after he's installed as USAG.
