Kerry/Edwards lawyers warn TV stations over Swift Boat ad

In Rush's closing segment he said that he just received a story or document saying that lawyers for both the Kerry and Edwards teams were sending out letters to TV stations warning them about showing the Swift Boat Veterans for Truth advertisement!

I thought the ads were selected small market buys. This threat of a lawsuit almost assures national news coverage, which even is better than buying a national ad. :o)

Remember the Willie Horton ad from 1988? The Bush campaign ran it one time. Thats it. It ran once as a paid advertisement. After that, the dems went bonkers and it was played over and over and over on every channel.

And never mind that it was Algore that brought up Willie Horton first in the RAT primary.

That brings up an interesting thought--why didn't "WE" scream foul and threaten to sue for all the lies in the movie? I realize if it had been promoted as fiction there might have been a problem, but wasn't it promoted as a documentary and therefore subject to a stronger set of rules and standards?

The letter also says that the doctor in the ad claiming he treated Kerry is lying and didn't treat Kerry.

It should be pretty easy for Kerry to show he is lying if that is the case. Produce your medical records that document who treated you Kerry!

OK, so what about the claim on the fax that says none of the guys saying those nasty things about Kerry even served on either of the two boats (PCF 44 & whatever) he was on? That's a good question. How does one explain that?

FWIW, here's a link to an article that suggests that legal efforts against the ad are doomed to failure. An excerpt:

Laws protecting consumers from false advertising of products are enforced pretty vigorously. For example, the Federal Trade Commission (FTC) took action in 2002 to protect the public from the self-proclaimed psychic "Miss Cleo," whom the FTC said promised free readings over the phone and then socked her gullible clients with enormous telephone charges. The FTC even forced a toy company a while back to stop running ads showing its "Bouncin' Kid Ballerina Kid" doll standing alone and twirling gracefully without human assistance, which the FTC said was video hokum.

But there's no such truth-in-advertising law governing federal candidates. They can legally lie about almost anything they want. In fact, the Federal Comunications Act even requires broadcasters who run candidate ads to show them uncensored, even if the broadcasters believe their content to be offensive or false.

And of course, if the ad is true, case closed.
