President Bush can cap all these 39 hours by announcing beginning Monday, November 17, 2003 recess appointments will commence due to the obstruction by the democrats. Qualifying candidates are numerous.... Republicans win the day.

The 39 hours was about the 4 who have been denied a floor vote.....and a serious blow to the Constutution by the Democrats. They usually use the Judiciary to to get what they want and diminish the Legislative Branch. This time they used the Legislative Branch to diminish the Judiciary and the Executive Branches.

No one can force the Democrats to hold the floor, so I don't understand your point for Frist to force a 'real' filibuster. Certainly holding the floor is one way to obstruct and filibuster, (like what Reid did the other day), but the Democrats are obstructing (filibustering) by not allowing the Senate to vote using parliamentary rules. They can do this, and are, without holding the floor, as long as they have 41 Senators to vote against cloture.

What angers me is the way the Undemocratic (they won't let us vote) Party has been pissing on the Constitution for the last several years...and the public is too ignorant to recognize it when it happens...

Indeed. Senator Cornyn saying that what transpired was a battle, and that the "war" is not over. The GOP is on the right side of this argument. I sure hope they prosecute the war to an appropriate conclusion.

Lindsey Graham said just that last night.That dog won't hunt, it's a non justiciable issue. SCOTUS won't touch it.
It's a politcal issue to be decided through politics. The republicans simply need to find the wherewithal to change the senate rules regarding the filibustering of federal judges and I don't even know if they have the votes to do that.
As for the notion that the pubbies will reciprocate in kind should a dem President be elected, history says they won't. The left wing media will pound them, unlike the non pounding of the dims, and they will fold if history is any indication.
Of course, if President Bush wins big in 04, everything changes. The dims have a tough road to hoe. They have alienated the south totally and voter registration in swing states is trending pubbie.
All that said, I'm glad to see the pubbies doing something pro-active for a change. Make it a campaign issue and when President Bush wins, he'll have a mandate for putting conservatives on the court.
How about a big:
Conservatives Need Not ApplY??? ad campaign?

Leon Holmes is nominated to a District Court in Arkansas. This is a ploy by the dims for positive sound bytes, to show they are not obstructing. Judge Holmes is no danger to them now for higher courts. They can fight that battle down the road. Not really
The Dems are still sending a message that Conservative Women Need Not Apply and telling Black Conservative Women that they aren't black enough

His hearing was back in March. I think he was approved by a 10-9 party line vote in the Committee without a recommendation....

cornyn is discussing the rules change. my guess is that there's some bigtime arm twisting going on in the cloakroom to bring the recalcitrant republicans into line. sure hope so. it would be dandy to get the rules change through and solve this problem.

IMHO they were trying to make it
look like they could have a vote right away on Holmes. As if the dems could then say
they were able to get a judge approved today.
Pryor wanted the Senators to approve (an amendment?) saying that
- the Judicial Committee should bring up Pryor's name for consideration.
- Then there should be an agreed upon number hours (five?) of debate.
- Then there should be an immediate (no intervening business) vote on Holmes.
