Nassau Ceases Enforcement of Smoking Ban

Nassau County officials ceased enforcement of a three-month-old smoking ban after a U.S. District Court judge issued a preliminary injunction against the law late Tuesday.
Judge Denis R. Hurley sided with a group of bar and restaurant owners who sued the county on March 11, claiming that the law is confusing and unconstitutional because it did not repeal a 1998 law that allowed smoking in special smoking rooms.

This means that folks in NYC, at least in eastern Queens, will be crossing the county line to smoke in bars and restaurants. Sort of like dry counties in the south.

They've been sending people outside to smoke and they get kinda loud late at night. Great news!

Smokers could give that pendulum a big boost if they expressed their outrage nationwide.
The Liberals have many activist groups, Greenpiss comes to mind, to steal our freedoms one little right at a time. Conservatives are too nice to rock the boat the way Liberals do.
If smokers were to "Act Up" the way the transgender crowd does, all this silliness would come to an and.

Sure, smokers are really amazing when you think about it. They carry a larger tax burden than the rest of society, yet don't complain about the constant harrassment they get over their legal and beneficial activity.

I think there is more to it than that because it doesn't make much sense to continue the court case on a poorly written county law with the State ban looming in July. All they get is a 1½ Months.
I believe they also sued on 5th Admentment grounds, The Eminent Domain clauss on siezing property.
It's hard to tell with this article, Newsday is a piece of S!-!Ï newspaper that makes the NY Times seem like a ultra right wing paper.

"I would be willing to suggest to our caucus that we conform our law with the state law, so that there is a level playing field," said Nassau Presiding Officer Judy Jacobs (D-Woodbury). "That was always our intention."The truth comes out.
The smoke-free establishments aren't competing very well with the establishments that allow smoking so they want, "a level playing field".
We can't compete! Save us Big Daddy govt!
