The prosecutor in the Kobe Bryant rape case says he has slam-dunk evidence to prove the NBA superstar's guilt, it was revealed on the eve of the hoopster's first court appearance today. Eagle County District Attorney Mark Hurlbert made that strong claim in court papers arguing against making public the police affidavit written to justify Bryant's arrest early last month.

If you were in favor of fairness, you would not call Rita a liar-based on no evidence, you would not completely discount reports that hurt Kobe's defense, and you would not call people who disagree with you names. You have a perfect right to be convinced Kobe is innocent no matter what-but don't don't pretend you are interested in being "fair" to the victim.

Why do the FReeper threads on this subject seem to divide into mostly two distinct "cheerleader" sections, each cheering on either the defense or the prosecution, when *NO ONE* in this forum knows the truth about what happened?

Probably because people who have absolutely no opinion on the case don't even bother with these threads. We have a lot of true crime enthusiasts here at FR, including me, and I love these threads.

I know that we do not know a thing. However, I play it out like a chess game: what DA, even a fame-hungry one, would go up against a Dream Team of a Kobe Bryant with a weak accusation on the story of a known emotionally challenged person with a flaky past? That's why and only why I come down on the side that says he raped her or else he beat her in the process of consensual sex, the difference between the two the world can NEVER know.

The jury hears the evidence-usually including testimony from the victim and defendent- and decides who they believe. Men have been found guilty in he said/she said sexual assaults. Of course, they have been found innocent too. No one knows what a jury will do.

Is that a direct quote or is the writer being cute? In the Scott Peterson case, the prosecutor or someone on their team said they had, and I do quote directly, "a slam-dunk case." Do all prosecutors watch basketball? Or what?

I have questions based on the timing of events as reported. Facts would be nice. He may have done it, he may not have. At the very least, he is an adulterer. Vanessa should be allowed to beat the crap out of him.

If you are a Kobe fan, you better hope that the prosecutors don't present the same amount of evidence as was presented in the OJ case.

If you are a fan of justice, let's hope these prosecutors don't use barking dogs to prove timelines.

He didn't say anything. He made court filings two weeks ago and the judge unsealed it.

Maybe the DA is a fool that doesn't even know how to play chess. For all I know, he didn't even know about the attempted suicide at her college.

Personally, I know of three rapes that were never reported for that very reason.

"Who would believe me with my history?"

Scary in a sense...because it supports the premise that you can get away with rape if you pick the right victim and assure there are no witnesses.

Kobe's image and the "right" to hero-worship must be protected, damn everyone else.

That plus Kobe's 'spensive lawyers would mean a DA with 3-digit IQ would have to have damning proof of force or he wouldn't charge. I am going with that as the most intelligent choice. Kobe must have really roughed her up.

I hope you are wrong. As you know, there is nothing wrong with your reasoning. There must be something to this purported physical evidence, or they wouldn't be leaking what they are. But, I won't believe it until I see it. This is the DA leaking, afterall.

The facts that are known are what has me leaning toward Kobe. The DA does not necessarily have a good case, just because he brought it. He thought about it long and hard before deciding. If this was a 'slam dunk', he would have acted faster.

A clip was on my radio this morning from the DA! I think it was in bad form to put that in a any court record. That is over the top and something any prosecutor or trial lawyer should avoid.

That is just downright arrogant and has no place in a Court document period! I am not changing my mind -- saying a case is a "slam dunk" is dumb and dumber. You never know what might come out in a Court and how witnesses will react on the stand.

A good analogy was the halftime of a playoff game between Buffalo and the Oilers. The Oilers were up big time at half and everyone was declaring the game over -- Buffalo came back and won!

As my Grandmother used to say -- don't count your chickens before they are hatched!
