MSNBC: Alleged (Kobe Byrant) Victim seen bragging at a party 3 days later

I just saw it on MSNBC. They said she was at a party a week ago, 3 days before Kobe was charged.
They said she was drinking (consumption by a minor) and playing cards, and was bragging about.....(MSNBC took out the audio at the end of sentence)
The story was confirmed by 5 people at separate places and times who were at the party and all gave a similar account of what happened.
When asked how the girl looked, the guy interviewed said she looked happy. Everyone was shocked to see her at the party given the incident.
I think someone may have even asked how hung was Kobe upon which she described with hand gestures. She seemed to be bragging according to a friend, but said she couldn't tell them what happened that night.
This just keeps getting better and better...

What a ridiculous idea. In our system of innocent until proven guilty "beyond a reasonable doubt" a significant number of criminals skate at trial due to lack of evidence, contaminated evidence, prosecutorial ineptitude, lack of witnesses or non-credible witnesses, ill-advised jurors, the ability of some accused to out spend the prosecution, etc...
That's the system. It often leaves legitimate victims feeling twice raped. You two want them to go to jail for it...what nonsense.

Neal Boortz proposed yesterday, because of the high percentage of rape allegations that are false that a law should be passed that if you accuse someone of rape falsely, you go to jail for the amount of time the wrongly accused would have served if convicted. Nice idea, but most of the false accusers would still skate. In a lot of these cases, it would be just as hard to prove beyond a reasonable doubt that the accuser lied as to prove beyond a reasonable doubt that the defendant raped her.

Who ARE these people? Do they have names and faces that they are willing to disclose on screen, or will they only whisper to reporters this schtuff on the condition of anonymity? Where have you been? Yes they all have names and faces and they have been reported. The name of the kid that hosted the party is Steve Avancho (sp?)

They are destroying this woman's credibility and the prosecutor's case. Of course, if what they say is true, the woman has no credibility and the prosecutor has no case. What is destructible must be destroyed, if justice is to prevail!

Maybe it's time to return to that concept...if a girl willingly goes to that hotel room in the middle of the night, it's bad judgement or stupidity, but why is the legal system involved?
That being said, I think Kobe Bryant is a jerk. Since we don't live in that era anymore, I'll be a cynic. The girl "struck gold"...I bet she could've gotten a nice financial settlement if she shut up. It makes me think she really is deranged.
Ahhhh...reasoning from the premises of today is just so weird.

I didn't know there was an actual link to a MSNBC story about this, since I knew that you didn't quote the source (MSNBC wouldn't have allowed "I think someone may have even asked how hung was Kobe" on its site).
After hitting the link, what a surprise -- there is the name of Steve Evancho, but also there are the names of Luke Bray and Sara Dabner. You didn't quote them.
Why not?

Why not have the victem and the accused (with their permission of course) submit to a lie detector test, be questioned under the influence of sodium pentathol and finally under hypnosis. All tests administered by experts in those fields who have submitted to and passed the same three tests, while being questioned about their own judgements as to the guilt or innocence of alleged victem and alleged perp.
Such tests are not recognized in court, but it could give us all a little more information upon which to establish our position.

One can see that the woman could easily feel that she was the victim of false pretenses which -- after she gives it some thought -- causes her to conclude that she really didn't consent to what happened and therefore it must have been rape. In my mind, this is the most likely scenario. The girl either did not get as much (snuggling, a morning phone call,etc.) or more (anal penetration, rough handling)than she bargained for.
