Her extensive drug history would seem to eliminate the original defense that she was a helpless victim of drugs; someone who didn't use and was accidently dosed.

The jury was removed for some reason.

WEll, that may explain why some of the nurses taking care of my mother were just great and others couldn't walk and chew gum at the same time, let alone move their asses faster than a snail.

It's the Ecstasy's fault!Otherwise her upbringing would have let her know to do the right thing.She was a corrections officer and doing weed in addition to nursing under the influence.

That could be. Where I am we are not getting continuous coverage. Cable channels are in and out and not showing it all. I heard a male doing the questioning and knew the prosecutor questioning yesterday was female. Thus, I assumed it was the defense doing the questioning a few minutes ago.

Wonder if Fox will continue to carry it past the hour? Court TV is about to go to the far more important (!) "Profiler" reruns.

That show is awful. I can't believe they pay to show it. Or do they pay?

Whoever is questioning her seems to be asking some of the most irrelevant questions.

Talking about how she hid urine samples on herself at work? I understand this goes to pattern, but it is way much on minutia. This is the penalty phase, not the trial. The trial is over.

[Although, FoxNews reported earlier today that any testimony Mallard might give in the penalty phase could be used in any future appeals trials. That may be the reason for all this minutia questioning on seemingly irrelevant things.]

You'll celebrate all you want, but you know this is an innocent black female being framed by the FBI (like O.J.) and the KKK. They are the ones that put drugs in her drinks and planted the man in her car, to make her think she has done it. If there is any justice, she will go free.

I don't recall seeing the testimony without the jury before ...it seems like "practice"!

Looks like practice to me too. I guess this is why she didn't testify during the trial. Nothing like being able to practice before getting nailed. Of course she can't maintain her cry act when she doesn't know the questions before hand. The difference in testimony is like night and day now.

Your Honor,
You see, this homeless man jumped through the window of my clients car without bothering to see whether it was open. He was attempting to hijack her vehicle by using his whole body to crash through my unsuspecting client's windshield from the passenger side. He hid along a dark curve and jumped onto my unsuspecting client's car as she was driving home from a hard day's work caring for elderly patients in a local nursing home.

I agree with you, but accident? People do not accidently take drugs or drink when they know they are going to be driving themselves home. But in all fairness I think I understand what you really meant by "accident", in that she didn't intend on hitting anyone that night, under the influence or not. : )
