As I watch Pearl Harbor tonight, I think about the great shame these people do to those who fought and died for our freedoms:

Freedoms that these people abuse for self interest.

But then there's James and his FreeRepublic.com on the other side of the scale, and that's a mighty heavy weight indeed

Other LEGAL EXPERTS who have read the "plain text" disagree with you. To a person. So far, you'll the only person I've seen saying she has a case.

If Wilson was not appointed to fill the rest of the term, then she was not appointed to anything. She did not protest, saying that she wanted a 6 year term, but rather accepted the appointment that she got. I would throw her out using federal marshals. Better yet, if she resists, use deadly force. She is a terrorist, and is usurping authority that is not hers. This would be like FD Roosevelt deciding to not hold elections in 1940. Of course, some advised him not to. He had more sense than that. And then bill her estate for the rental of the federal marshalls.

Ok, don't use the federal marshalls. Rather, publish her address and driver's license number for the people to take direct action against this usurper, and Bob Ashcroft should announce that federal procecuters will not enforce the laws protecting her from action by the people. If a tyrant needs shooting, they need shooting, and the person who does it deserves a medal.

Let's not forget that Mary Frances Berry is the one who said that blacks in Florida did not get to the vote -- flying in the face of every fact known to man. -- and still maintained that position when she herself (the little troll) was unable to produce one PERSON or one FACT to back up her assessment during her OWN hearings.

Like I'm going to believe HER interpretation of anything.

I can understand your interpretation of the law. However, an additional piece of information that works against this interpretation is the GAO Plum Book. Published by the government and reviewed by the US Civil Rights Commission and the Senate Cmte on Governmental Oversight, clearly listed the position as expiring on November 29th, 2001. So, how will Berry explain the fact that she reviewed and accepted the inevitable end to Wilson's time on the board as is listed in the Plum book?? Hmmm? BTW, how do YOU interpret the listing in the GAO Plum Book?

It was clearly printed in the GAO Plum book that Wilson's seat was expiring on November 29,2001. DO THESE FREAKS NEED READING LESSONS?!?!?! WHAT IS GOING ON HERE. GET THE MARSHALS IN THERE TO REMOVE WILSON FROM THE SEAT NOW!!! $123 thousand a year, Wilson should be fined that amount for every day her fat butt sits on that panel!! FREEPERS UNITE!!

AMENDMENTS

1994 - Pub. L. 103-419 amended section generally, substituting provisions relating to establishment of United States Commission on Civil Rights for provisions relating to Commission on Civil Rights.

So apparently President Bush would need the concurrence of a majority of the members of the commission (i.e., at least five) to change the chairman. With the current membership, he's not going to get that.

While looking things up I found the minutes of the house oversight committee and the report form the GAO was devastating. This Commission was/is very poorly run with no accountability. So your finding of this "typo" is par for this committee.

In other words they will plead it was an administrative oversight.

Apparently so, I don't know when that will occur based upon others reaching their expiration dates. Of course an independent replacing a democrat member that leans or votes with the republicans could turn the tide quicker if a democrat is the next up replacement.

Well, as long as folks such as yourself are open to this "interpretation" for ignorant and wreckless government officials, you're probably right. If the tables were turned the Dems would have this broadcast on the nightly news as a travesty and abuse of power by a rogue committee chairperson. I'm not budging, and neither should you. It's sad to see that you would even offer them the opportunity to present such a weak argument.

in fact clinton put a date final on his appointment of wilson , that date is nov 21 or 25 2001. so neither berry nor wilson have a leg to stand on.

Clinton didn't have authority from Congress to limit her term. The simple clear language says her term SHALL be 6 years.

Remember the Florida elections where we argued the Rats argued that Shall means May. We are doing the same thing here.

Do you have any information as to pay if any given to these people on the commission. What exactly are they supposed to accomplish.

I wastched the sham they called hearings in Florida. That was ridiculous. How long has Berry been on the commission and how do we get rid of her. As well as the commission.
