States sue to stop Trump rule that would make it harder for some immigrants to get green cards

New York and 21 other states are suing the Trump administration to block a new Department of Homeland Security rule that would give immigration officials wider discretion to deny green cards, visas or entry into the United States when determining whether applicants could become dependent on government aid.

The rule change, set to take effect Friday, likely would make it tougher for many immigrants to obtain green cards if they use or are deemed likely to need public benefits such as food stamps, Medicaid or housing vouchers.

New York State Attorney General Letitia James and New York City Mayor Zohran Mamdani, who is leading a coalition of cities filing a similar lawsuit, are expected to announce the legal action during a press conference at City Hall on Monday, James’ office said.

The states, whose lawsuit also includes the District of Columbia, argue they would lose billions of dollars in federal funding if immigrants, particularly mixed-status families, disenroll from programs due to fears about immigration consequences.

The lawsuit relates to pending changes to what’s known as the “public charge” rule, a provision of US immigration law that allows the government to deny a visa or green card to someone it determines is likely to become dependent on government assistance.

Historically, immigration officers counted only cash benefits, such as Temporary Assistance for Needy Families or Supplemental Security Income from Social Security, in their evaluations. But the Trump administration’s pending change does not specify which safety net programs should be considered – meaning non-cash benefits like Medicaid and housing vouchers can be.

“Hardworking families should not be forced to go without the support they need because they fear asking for assistance will get them deported,” James said in a release.

More of the ongoing lawfare civil war.

Imagine if we lose the midterms. People will look back at these relatively peaceful years like we do with the pre-9/11 years.

Allowing an invasion of illegals taking entitlements and defying the legal system to walk free cannot be allowed to stand.

Do you mean the 1940s-1950s? We've had entitlements roughly beginning with FDR's New Deal.

Paul Harvey had a show where he said welfare recipients (white and other races) used to cover over going on it and hid it from church congregations and neighborhoods and stores so they wouldn't have to be ashamed that others knew.

Then, he said, as "entitlements" people demand their rights to money and aid because "I am entitled to it."

Then go back to your home country and get your "support" there! Not on the backs of hard-working, strapped Americans.

That statement alone should DQ that witch from office. Always what's best for illegals, screw the citizens and taxpayers.

More of the ‘..hardworking families..’ BS. The DNC marketing department did a nice job on that one, it resonates with those who will not think it through.

There is no obligation for us to take on a buden to society. It’s a play to grow the dependent DNC voter base at the expense of already burdened taxpayers.

Historically, even during the Ellis Island boom, no immigrants were allowed if there were deemed to be public charge.
Only immigrants, who would be likely contributing positively to the society were allowed in.

Somehow, this was forgotten a while ago.

It is not just illiterate immigrants.
I met some immigrant family, who made it to the USA, just because they had son with Down syndrome and US has better programs for that than Europe!

That used to be in the immigration laws -- no deadbeats allowed.

Now, not only are they deadbeats, they are committing Massive Fraud.

With free EIB cards, health care for all family members, free housing, free college education in some states, monthly income via welfare, what else? A new car? A new set of clothing? Free citizenship. Free registration to vote. Hell, I think I will go south and come in as an illegal and get all these added bennies to my retirement. When we went to the ER, there were at least 40-60 Latinos outside the ER, and the parking lot was packed. It was only about 8:45 pm. We drove 6 miles further to a smaller hospital ER, and there were no illegals there. We saw a doctor within 10 minutes!!! They have not invaded there yet.
