FIRST ON FOX: Nearly all Republican attorneys general asked the Supreme Court on Friday to side with President Donald Trump in his fight to curtail birthright citizenship, offering a wide show of support for one of the president’s most controversial agenda items.

The 24 states, led by Iowa’s Brenna Bird and Tennessee’s Jonathan Skrmetti, argued in an amicus brief that the 14th Amendment, which addresses birthright citizenship, was not designed to give automatic citizenship to babies born to mothers living in the country illegally or temporarily visiting.

Birth right citizenship will remain the law.

Only it will be restricted to the children of citizens or lawful permanent residents, as it was always intended to be.

The same rationale used for foreign Diplomats and children born to them while serving in the US should be used for parents who are citizens of a foreign country birthing children in the US. It’s essentially the same thing. Is it not?

This is THE single biggest issue to resolving the flood of illegal entry and visa overstays in this country. We simply cannot have people walk or fly across the border, legally and illegally, and plop out US citizens. That is insane and no other country in the world allows such foolishness.

Now make it retroactive to the late 60’s when that commie-loving Kennedy (the U-boat commander) pushed through the immigration cahnges and his fellow travelers in the judiciary decided anybody dropping a kid on US soil hits the lottery.

Unfortunately, neither the Congress or the Courts can create retroactive laws as it is forbidden in Article I, Section 9, Clause 3 of the U.S. Constitution, which bans Congress from enacting ex post facto laws, and in Article I, Section 10, Clause 1 prohibiting states from doing the same.

This is why Trump’s executive order did not do so as it would have been unconstitutional on its face and the subject would never have made it to SCOTUS as it would have been invalidated on facial grounds instead of getting an as-applied examination of its actual subject matter.

Trump has followed the very best legal thinkers on this.

The other big issue is the census. It in encourages illegal emigration by counting illegals in census. That is used in turn to decide congressional apportionment and a dozen other goodies.

Trump will push his agenda to the limit if he can get bigger majorities in the house and senate. This year and the next are only a prelude of what’s to come. But what happens next depends on what happens in the fall next year.
