The Supreme Court has already expanded President Donald Trump’s authority in a string of emergency rulings, but he’s signaling in his firing of Federal Reserve governor Lisa Cook and other issues likely headed to the court that he continues to seek broader powers for the executive branch.

The cases could serve as major tests of how much further the nation’s high court is willing to go to bless the president’s assertion of executive authority. They differ from previous showdowns because of the sheer magnitude of the authority Trump is seeking to wield and because he wants greater control over powers the Constitution ascribes to another branch of government......

The high court has already signaled openness to broad presidential authority to replace some heads of independent agencies.

The justices handed Trump a major victory in May when they allowed him to remove the leaders of the National Labor Relations Board and the Merit Systems Protection Board while legal challenges play out over their firings. Trump gave no reasons for the dismissals.

The court’s conservative majority ruled the Constitution vests all executive power in the president, so Trump could fire the agency heads “without cause” even though Congress set up the agencies to be insulated from political interference......

The legal battle over Cook’s firing is likely to turn on how the courts interpret “for cause” — something not defined in the law creating the Fed and has never been litigated before......

Lauren Bateman, an attorney for plaintiffs in the foreign aid case, contends it was always the administration’s intent “to run out the clock and allow those funds to expire" against the wishes of Congress.

“The administration’s affronts to the rule of law are staggering — and all to withhold aid from the most vulnerable people in the world,”

There is nothing in the Constitution about "independent agencies", the power grab was/is congress creating unconstitutional agencies.

Why should he give a reason to anyone who has no jurisdiction over the firings?

The Chielf Executive is the one who decides.

SCOTUS did not expand Presidential powers.

SCOTUS ruled that the powers have always existed

President Trump filed law suits that brought the matters to SCOTUS attention.

The Supreme Court has issued several rulings affecting Donald Trump and future presidents’ powers, most notably on presidential immunity from criminal prosecution. The Court has also ruled on presidential authority over executive agency heads and lower court injunctions against executive actions.

Presidential immunity from prosecution
On July 1, 2024, in Trump v. United States, the Court ruled that former presidents have immunity from criminal prosecution for their “official acts”.

Immunity for official acts: In a 6–3 decision, the Court determined that the Constitution grants former presidents absolute immunity for “core” exclusive presidential powers, such as the pardon power. It also ruled there is a presumption of immunity for other “official acts”.

No immunity for unofficial acts: The Court was clear that this immunity does not cover “unofficial acts,” including actions taken as a candidate or private citizen.

Case remanded for review: The case was sent back to the trial court to determine which of Trump’s actions related to the January 6th indictment were “official” versus “unofficial,” a process that will likely delay the trial until after the November 2024 election.

Authority over executive agencies
In a May 2025 ruling involving the National Labor Relations Board and the Merit Systems Protection Board, the Court significantly affirmed presidential authority over some independent agencies.

The 6–3 majority held that the Constitution vests all executive power in the president, giving him the right to fire some agency heads “without cause”.

The ruling was seen as a victory for the executive branch’s power over independent bodies, although the Court drew a line with the Federal Reserve, suggesting its governors can only be removed for cause.

Limiting nationwide injunctions
On June 27, 2025, the Court issued a major decision limiting federal judges’ power to block presidential orders with nationwide injunctions.

The case originated from a challenge to an executive order by Trump regarding birthright citizenship.

The ruling found that universal injunctions “likely exceed the equitable authority” of federal courts, effectively curbing a common judicial check on executive actions.
This decision empowers the president to enact policies that might have previously been halted by lower courts.

Broader impact on presidential power
These decisions have been widely interpreted as expanding the power of the presidency, particularly the immunity ruling that allows presidents to act with greater protection from criminal liability for actions taken in office.

Shifting balance of power: Legal experts and critics argue the immunity ruling significantly shifts power away from Congress and the judiciary toward the executive branch.
Criticism from dissent: The Court’s liberal justices have issued strong dissents, with Justice Sonia Sotomayor warning that the immunity ruling turns the president into a “king above the law” and opens the door for a wide range of unchecked criminal acts.

WaPo’s deliberate ignorance is astounding

What part of government does the Federal Reserve belong to? If not the Executive, then who? And if the answer is the Executive, then it would not be permitted to exist at all but for it ultimately reporting to a branch that is answerable to the electorate.

If the answer is that the Fed reports to no one and is independent, then I am confused. Trump is a dictator yet is subject to the Courts and Congress. How is it not dictatorial to have a governing body that reports to nobody?!?

SCOTUS decisions retook the powers of the President from those who had no right to to steal Presidential powers for their branch.

The judiciary does not have Presidential powers.

Perhaps the Washington Compost wou.d rather that president Trump IGNORE the supreme court altogether like biden did and just do whatever he wants while threatening the SC not to interfere?

Pres Trump is NOT seeking more power! He is seeking g to have the courts uphold the powers ALREADY GRANTED TO HIM! Because the left keep usurping the law and making illegal ru.ings again t him in an effort to derail his presidency and promises!

If an agency falls under the executive branch, then the President as chief executive certainly has the power to fire personnel, for any reason whatsoever, even if he just doesn't like their socks.

This piece reads similar to, or like how the usual suspects will say the Constitution “gives” the People rights.

The CINC or president has enormous power to act unilaterally, that may not be popular at times, it may not be utilized when it should, but the court isn’t “expanding” anything, but merely recognizing or acknowledging the broad powers the chief executive has, that everyone knows he has.

They just don’t like it. It’s really bizarre to watch all these learned legal scholars in and out of the government and media twist themselves into logic pretzels to try and justify “Get Trump”.

To some degree, the Supreme Court seems to be grudgingly acknowledging the limits of judicial power under the Constitution.
