A federal judge in New Hampshire granted class-action status to a lawsuit seeking to protect babies who would be denied birthright citizenship by the Trump administration and granted a temporary block of the order restricting birthright citizenship from going into effect throughout the country.
The suit was brought on behalf of a pregnant immigrant, immigrant parents and their infants and had sought class action status for all babies around the country who would be affected by Trump’s executive order and their parents.
Cody Wofsy, the lead attorney on the case with the American Civil Liberties Union, argued for class-action status in front of U.S. District Judge Joseph Laplante Thursday morning, stating that their clients would suffer irreparable harm by being denied birthright citizenship, a claim with which the judge found credible.
Laplante ordered during the hearing that class-action status be certified in the case but only for the babies who would be impacted by the restrictions, not for the parents.
He also ordered a preliminary injunction temporarily blocking Trump’s order from going into effect, but stayed his order for seven days, allowing the government time to appeal.
"Today, the court certified a class nationwide of children who are impacted by the President's executive order and enjoined it from going into effect on July 27 this is going to protect every single child around the country from this lawless, unconstitutional and cruel executive order," Wofsy said at a news conference after the hearing. Class actions were specifically exempted.
And that's the problem. Every day some jackass Federal District "Judge" enjoins the President ... and the President goes along with it ... is another day lost to implementing the President's lawful and constitutional agenda.
The game isn't really to defeat the President ... the game is to run out the clock on him. It is to keep him constantly wrapped up in spurious legal red tape. In four years (they think) Gavin Newsom, or some similar creature, will be in the White House ... and then the President will have unchecked absolute power to do anything he wants.
Bad news. I'll say that Gavin Newsom has a 50% chance of winning the presidential election in 2028.
Kamala Harris won 48% of the popular vote and she was probably the worst presidential candidate of all time.
All Gavin Newsom has to do is to perform better with women and he's in the White House. He's slick and of course, he's handsome.
I hate to break this to you, but you were never ever going to get “end of birthright citizenship” without the supreme court chiming in, short of a constitutional amendment.
Yes on lots of things the left is just using courts to obstruct and delay, but on this particular item, it would not matter which side was doing this, it was going to the USSC no matter what.

only that a district judge could not issue nationwide injunctions. Nothing prevents them from doing exactly this, with class action status.

The left is obsessed with the idea that Trump is acting like a king, and doesn’t respect the Judicial system. Yet, they love it when a rogue judge ignores the decision of the Supreme Court from just last week.
This is all chaff.
The USSC is going to endorse birthright citizenship 9-0 and that will be that.
Arguments against it are foolish. The Constitution needs to be amended to stop it.
I blame the USSC above others.

Courts have to follow Rule 23 procedures in order to for broad relief,so no they were not exempted at will. This ruling didn’t follow 23 since this judge completely ignored discovery.

If the Judges are ignoring SCOTUS, then Trump should ignore the Judges.
I live in King County (Seattle), Washington.
My local neighborhood has thousands of immigrants.
EVERY immigrant couple is pushing a baby stroller or watching a toddler learn how to walk.
The news gets worse - pregnant women and children under 18, regardless of immigration status, are eligible for free Medicaid and the full menu of USA funded welfare.
Federal judges are not above the Constitution. Unless the judge has sound constitutional basis and reasoning for his ruling, the decision should be ignored howbeit also with sound constitutional basis for nullifying the unconstitutional decision.
