Biden-appointed judge thwarts Trump's attempt to clean house at consumer safety agency

A federal judge in Maryland on Friday ruled that President Donald Trump lacked the authority to fire three Democratic members of the Consumer Product Safety Commission (CPSC) and ordered their reinstatement — teeing up another high-stakes court clash centered on Trump's ability as commander-in-chief to remove or otherwise control the members of independent agencies.

U.S. District Judge Matthew Maddox, a Biden appointee, sided with the three ousted members of the board — Mary Boyle, Alexander Hoehn-Saric and Richard Trumka Jr. — in ruling that their firings were unlawful and ordered all three members to be reinstated to their posts.

In his ruling, Maddox said that the tenured design and protection of the five-member, staggered-term CPSC board does "not interfere with" Trump’s executive branch powers under Article II of the U.S. Constitution.

The decision is a near-term blow for Trump, and comes just weeks after the Supreme Court last month agreed to uphold, for now, Trump's removal of two Democratic appointees from the National Labor Relations Board (NLRB) and the Merit Systems Protections Board (MSPB).

Both board members had challenged their terminations as "unlawful" in separate lawsuits filed in D.C. federal court. The Supreme Court voted 6-3 in May to temporarily allow the firing of both board members, siding with lawyers for the Trump administration, who had urged the justices to keep both members on the job while the case continued to move through the lower courts.

In his ruling, Maddox sought to distinguish those cases from the terminations of members of the CPSC board and said that the Trump administration, in this case, had failed to identify neglect or malfeasance by any other Senate-confirmed commissioners on the CPSC, which is required by law to justify their removals.

They should be fined big money every time they are overturned for wasting tax payer money. Roberts belongs in prison for this crap and congress needs to close half the district courts. There are too many judges.

Whose removals? I don’t even understand this statement. Are these people confirmed by the Senate? If not, tough, you’re fired!

The President is commander-in-chief of the Army and the Navy, not of the United States.

He can fire these people because he is the head of the Executive Branch in whom the executive Power of the United States is vested - but firing civilians has nothing to do with his status as C-in-C.

FR: Never Accept the Premise of Your Opponent’s Argument

First, the only mention of safety in the Constitution limits the fed's power to deal with public safety to suspension of writ of habeas corpus in troubled times.

Next, the first numbered clause in the Constitution (1.1), evidently a good place to hide this clause from Congress, clearly vests ALL federal legislative / regulatory powers in elected members of Congress, not to non-popularly elected bureaucrats who have undoubtedly helped to foster what are now politically known as career lawmakers.

Here's the post-17th Amendment ratification (popular voting for federal senators), politically correct version of 1.1.

"Article I, Section 1: All legislative Powers herein granted shall be vested in a Congress of the United States, which shall consist of a Senate and House of Representatives [and non-popularly-elected bureaucrats running Federal Reserve, IRS,EPA, BLM, NIH, CDC, FWS, DHS, DOL, USDA, FCC, FTA, FTC, DOE, ATF, DE, etc.]."

The bottom line is this imo. Deep state judges are wrongly ignoring that the federal agencies that PDJT47 is trying to get rid of have no express constitutional justification to exist in the first place imo.

As long as it works, and as long as weakling republic-nts keep “aw, shuck-ing” around like losers, they will do it FOREVER, or until the democrats finally achieve TOTAL control over the weak and stupid party. Judge didn’t say the board members couldn’t be removed.
Judge said our guys didn’t follow the rules as far as identifying why they were
eliminated.
The DOJ ain’t all that swift sometimes.
