Attorney’s Building Blunder In a high-stakes response to a federal criminal referral, Letitia James’ defense lawyer, Abbe David Lowell, submitted a letter to U.S. Attorney General Pamela Bondi that made a stunning error: he fundamentally misunderstood the very property at the center of the investigation. The letter, prompted by the FHFA’s referral for potential mortgage fraud, falsely claimed James’ Brooklyn property “has always functioned as a four-person residence.” But official records, utility infrastructure, and tenant complaints paint a very different—and legally significant—picture.

It's lengthy but worth reading to understand that James needs a different lawyer.

Lowell is following the white collar defense lawyer's playbook of initially putting forward the client's formal account of the episode. If that ploy is successful, the case may be downgraded or dropped entirely.

If not, if the case goes forward, the defendant and their lawyer have to deal with what most white collar defendants have a hard time accepting: that they did something criminal, or that at least appears criminal on the true facts.

The defense will then attempt to whittle down the government case and to develop reasonable doubt and possible defenses at trial. Often, the defense account of the facts changes from the asserted facts previously put forward.

My guess is that James will eventually claim to have relied on family members and professionals whom she trusted but who got things wrong. If any errors were made by James, they will be portrayed by her attorney as honest mistakes without criminal intent.

The professional skill of Lowell's initial letter may then become decisive as a statement of James' honest if mistaken belief as to what the facts were. If Lowell has done his job, the facts stated in his letter will be such as to defeat a prosecution if they were true.

A core strength of James' defense will be that, being a powerful state official, she may well have the ability to conjure up useful testimony and get favorable people on the jury. In short, as much as Lowell and James look to be off to a bad start on the facts, it is all part of a long battle that she has a fair chance of winning.

The problem here is that Lowell isn’t James’ attorney. He’s representing the office of the NY AG. So it’s kind of like an attorney defending a medical malpractice case on the basis that his client is retarded.

My guess is that James will eventually claim to have relied on family members and professionals whom she trusted but who got things wrong.

“I shouldn’t be prosecuted for this. It was all an honest mistake. Family members and professionals told me that I lived in Unit 1 at that address.”

I would be curious to know...if James (over the years) reported the full income (5 apartments) or partial income (4 apartments). Whoever was handling her tax paperwork...probably is a bit worried at this point.

There is also electrical meter service and landline phone service. Although landline service may not be and adequate reflection of occupancy today, it certainly would let’s say 10 years ago..

returns report income from 5 apts or partial income (from her claim of 4 apts)?

I wasn’t impressed with super lawyer Abbe David Lowell’s defense of Hunter. Being good in front of microphones isn’t the same as being good during a trial.

In other words, Letitia and maybe, also Lowell are intentionally lying to the court to make it appear that Ketitia misunderstands the circumstances of her properties, that sge relied in experts and other people involved her properties to advise her correctly and they didnt, so she is the one done wrong and it was all an innocent mistake by other people.
Your legal theory is likely what is happening but I wonder how it will play out when the fact is Letitia is a lawyer herself, NY AG, she prosecuted DJT for a related crime abd showed him absolutely no mercy.

I'm picturing Donald Trump's lawyer sending someone a letter and "falsely claiming" something. I imagine Trump should be charged with multiple felonies for just the letter.
