JUST IN: Judge Xinis Postpones Discovery in Kilmar Abrego Garcia Case

Judge Paula Xinis postponed discovery in Kilmar Abrego Garcia for one week in response to the Trump Administration’s request for a delay.

The judge did not give a reason for her decision to postpone the discovery.

“The Court has reviewed Defendants’ Motion to Stay and Plaintiffs’ Response. With the agreement of parties, the Court hereby ORDERS that discovery shall be stayed until April 30, 2025, at 5:00 PM,” the judge wrote.

I hope their sealed filing said something like this:

“You can take a flying leap if you think we are going to tell you how we are working with El Salvador, Mexico, or any other country to fight terrorists, transnational gangs, and cartels. Neither you nor your clerks have a high enough clearance for us to tell you that. SCOTUS has already ruled on what needs to happen in this case. They gave you two jobs: define “facilitate” and keep your butt out of foreign relations. You are in contempt on both counts. See you in court.”

Maybe accompanied with the filing to SCOTUS to find her in contempt.

Congratulations to Texas who gave “Texas Man” Moises Sandoval Mendoza his “dew” process tonight for murdering “Texas Mother” Rachelle O’Neill Tolleson. Mendoza killed Tolleson and Texas killed him back. The RATS are minus one voter tonight.

A couple data points here have me wondering...

There’s a thread discussing the 2 Mexican guys who were caught transporting 180,000 rounds of AK-47 ammo to Pueblo, CO, where there’s a lot of cartel activity. In that thread there is a link to a former-military podcaster who thinks this was a cartel ordering this ammo to be taken there and used to create massive machine-gun capabilities to be used on Ft Carson or on the NSA facility in Denver. Another poster on the thread mentioned that El Chapo (Guzman) is imprisoned not too far away. No matter how you slice it this could very well be the cartels with massive plans to bring the fight with the US military onto US soil. Another data point: Bondi just announced that they are charging a leader of Tren de Aragua on terrorism charges after he was apprehended by Columbia at the request of the US. That thread is at https://freerepublic.com/focus/f-news/4312906/posts

And now Xinis reversed herself and allowed a delay in discovery in this case after the DOJ made a sealed filing. I hope that what they told her was that there is no way that they are gonna let her snoop her nose into how we are combating terrorists, transnational gangs, and cartels because we’re talking a lot of people could get killed if she screws this up, and if she doesn’t want to land in Gitmo as a national security threat for her demands she better stand down.

My hope is that they have gotten intel on the cartel’s plans and who all is involved by interrogating these two men, and that the intel they received may even have helped lead to this TdA leader in Columbia. I think I remember reading that TdA does work with the cartels.

I was talking to someone more liberal, and was told that Garcia is a law abiding legal resident. Apparently liberal news reports that he is a legal resident, and not a member of MS13.

Just with the short exchange I had with that guy who’s more of a liberal, we can see the facts are in contradiction.

If he came to this country illegally how can he be a legal resident? And what’s with some media reporting as a fact that he is a member of MS13, while liberal media definitively say he is not a member? Both cannot be true at the same time

THACKER, Circuit Judge, with whom Judge KING joins, concurring:

The panel unanimously agrees that the district court’s order requiring the Government “to facilitate and effectuate the return of Plaintiff Kilmar Armando Abrego Garcia to the United States by no later than 11:59 PM on Monday, April 7, 2025,” should not be stayed.

The Government’s motion to stay is, therefore, denied. I write to explain my view.

The United States Government has no legal authority to snatch a person who is lawfully present in the United States off the street and remove him from the country without due process. The Government’s contention otherwise, and its argument that the federal courts are powerless to intervene, are unconscionable.

I.

Abrego Garcia is an El Salvadoran national who has been lawfully present in the United States since 2019, when he was granted withholding of removal to El Salvador. Abrego Garcia has no criminal history and has never even been charged with a crime in the United States, El Salvador, or any other country.

How come conservatives didn’t bring lawsuits against various aspects of Bidens open borders programs. We could have gotten favorable rulings from Federal district court judges in Texas and Arizona. We could have gone jurisdiction shopping too.

The DOJ submitted two sealed documents today. There must be sensitive foreign policy information inside. Let’s see if any of it leaks.

We need the Appellate Immigration Judge to weigh in on his withholding order. Judge David M. Jones (2019-2024) was appointed by Matthew Whitaker.
